All guns in U.S. should be dumped in ocean, judge says

As the killer stood before him, Judge Kenneth Walker couldn't stay silent.

"If I could I would take all the guns in America, put them on big barges and go dump them in the ocean," the judge told the defendant. "Nobody would have a gun. Not police, not security, not anybody. We should eliminate all of them. We could save 33,000 people a year if we didn't have guns in this country."

Marcell Lee Daniel Jr. had unleashed 30 bullets during an afternoon drive-by shooting of an innocent man on a North Portland sidewalk. The man, Andrew Coggins Jr., 24, died.

The judge kept going.

"Australia after a major shooting rounded up all the guns, and they haven't had near the death that we do here in this country," he said.

"I just saw last night a statistic that 11,000 people in America are murdered each year and another 20,000 commit suicide with guns," Walker said, referring to figures from the U.S. Centers for Disease Control and Prevention.

"They are a scourge of this country and no one should have one as far as I'm concerned," he said. "There's no defense to guns. There's just absolutely no reason to have them. But it is a right of people in this country to own and possess them, and I will not say anything to affect that right."

Walker, a Multnomah County Circuit Court judge for nearly 10 years and a criminal defense attorney before that for 25 years, sentenced Daniel to 17 1/2 years in prison.

People kill not weapons. Society is the killer in their attitude toward life. Far more babies are killed every year and guns are not used to do it. Society should teach more respect of life and not disrespect for it. Religion is the foundation of moral teaching and it gets trampled on daily. You want less crime, start by imposing real punishment for crimes, not 17 years in jail for taking someone’s life. The intent to kill is in the person not the weapon used. The judge is way off and his focus is on the wrong target.

many, if not most, law schools teach the "Berger Interpretation" of the Second Amendment (i.e. it applies only to members of the "militia", and not the populous).

Out here in the sticks, we don't call that "interpretation". We call it "lying".

I agree to some extent. When I started my business career it was still possible to seal a binding verbal agreement with a handshake. By the time I retired, it seemed even the simplest agreement required thousands of pages of legalese, and even then parties to the agreement would hire lawyers to walk away from the signed agreement or sue on technicalities. One reason I retired early from my career was disgust at the absence of ethics in the business world encouraged and facilitated by attorneys.

Unprincipled judges and attorneys are only a symptom of the underlying moral and cultural decay in our society that has accompanied the replacement of God’s commandments with self defined guiding principles. Without common standards of behavior, a society become increasingly lawless and then decays into anarchy. We are well on the way and attorneys, instead of upholding the rule of law, are enabling the lawless.

Nobody would be found guilty of anything.

Nobody would serve time.

It would be a perfect world.

By only giving the killer a 17 1/2 year sentence, it looks like Judge Walker is still acting like a criminal defense atty. Should have given the scumbag life without parole. It's not the guns that are the problem, it's lenient scummy judges like this that give criminals the ability get back on the street to terrorize more victims.
