As the killer stood before him, Judge Kenneth Walker couldn't stay silent.
"If I could I would take all the guns in America, put them on big barges and go dump them in the ocean," the judge told the defendant. "Nobody would have a gun. Not police, not security, not anybody. We should eliminate all of them. We could save 33,000 people a year if we didn't have guns in this country."
Marcell Lee Daniel Jr. had unleashed 30 bullets during an afternoon drive-by shooting of an innocent man on a North Portland sidewalk. The man, Andrew Coggins Jr., 24, died.
The judge kept going.
"Australia after a major shooting rounded up all the guns, and they haven't had near the death that we do here in this country," he said.
"I just saw last night a statistic that 11,000 people in America are murdered each year and another 20,000 commit suicide with guns," Walker said, referring to figures from the U.S. Centers for Disease Control and Prevention.
"They are a scourge of this country and no one should have one as far as I'm concerned," he said. "There's no defense to guns. There's just absolutely no reason to have them. But it is a right of people in this country to own and possess them, and I will not say anything to affect that right."
Walker, a Multnomah County Circuit Court judge for nearly 10 years and a criminal defense attorney before that for 25 years, sentenced Daniel to 17 1/2 years in prison.

But we’d still have drug gangs, illegal imported guns and mass stabbings. Stabbings are a major cause of death in Britain because there are so few guns.
Dump all the cars and knives too. Save a hell of a lot more lives. Very strange logic.

Judge Walker probably lives in a safe neighborhood, perhaps one that is gated and has armed security guards. The rest of us are not so blessed.
Better yet-let’s dump all the judges and lawyers in the ocean.
This judge should be removed from the bench. He clearly lacks the intellectual ability the job requires. If guns were not available to criminals, they would simply use knives or clubs or baseball bats or rocks and on and on and on. Get rid of this fool before he does serious damage to society.
Someone should explain to the good judge that dumping in the ocean is a crime and a complete environmental disaster . . .
This man is a judge but thinks all populations are the same. I think if Australia had the same populations and the same diversity they would have the same problems. The only people in Australia without guns are the law abiding.
There have been a couple of terrorist attacks using knives, but those people are several levels below criminals in intelligence. They also weren’t native enough to know where to buy illegal guns.
As for people committing suicide with a gun, those people would still attempt to kill themselves without guns. It would be messier and less certain. But the gun is not the cause of suicides. It is just the means.

Yes. He shows (at best) no understanding of the Constitution he is sworn to uphold. I suspect that in reality he actively rejects the Constitution. All of it, not just the Second Amendment. He's an oathbreaker.
Hammers, baseball bats, kitchen knives. Large wrenches, pressure cookers... pipes, chains, ice picks... automobiles...

Don’t forget to dump all bomb making materials, including fertilizer, that way we will all starve to death. This ignorant judge is why we have so much crime because they let criminals back out on the street.
What a dumbass. I own knives, bows, and even a few swords. I’m pretty sure I’m not the only one. So, dump alll the guns in the ocean and my sword becomes a very potent weapon.
Then the black market wold thrive.
Prohibition didn't work.
The war on drugs isn't working.
Gun control isn't working.
There were fewer shootings and mass murders when everyone kept a loaded rifle hanging above their front door and it was considered irresponsible to NOT have that.
Do accidents happen? Sure. But then we need to outlaw cars as well.
The idiot judge can take his opinion and put it somewhere where the sun doesn't shine.
How injudicious of the Judge. I will dump one gun though if he will dive in and go to the bottom first.
The judge is nuts. Gunpowder is an 11th Century invention, and guns are 13th Century technology. There is no way to uninvent them.
