Could Delegate's New Lawsuit Derail Trump's Nomination?

A Virginia delegate to the Republican National Convention filed a class action lawsuit in federal court Friday challenging a state law that binds delegates to support the primary winner at the nominating convention.

The outcome of the lawsuit could have significant implications for Donald Trump's nomination, as it will be a test case of a key argument being pushed by some Trump opponents who want to see him stopped at a contested convention.

These GOP establishment bassturds want Clinton to win

It's pretty obvious that it's the outcome they want. Let's say they could change the rules before the convention to deny Trump the nomination. Then what? Virtually none of Trump's supporters will vote for whoever they nominate in his place (Mitt, Jeb, etc). They know this, so these shenanigans are an obvious ploy to hamstring "their" own party and guarantee Hillary's victory?

Why, you may ask? Because the real divide isn't between Democrat and Republican, it's establishment vs. anti-establishment grassroots. An establishment Democrat like Clinton is a lot closer to a Bush-style establishment Republican than either are to a populist firebrand like Trump or his supporters.

There's also the spite aspect: the GOP establishment resents the fact that voters rather than the RNC got to pick the nominee this time, and they would sooner see the party crash and burn than allow that to ever happen again. As far as they're concerned, 2016 was Jeb's turn just like it was Hillary's.

Beau Correll, a Republican National Convention delegate who served as one of Cruz’s campaign co-chairs in Virginia’s 10th district, is the only named plaintiff in the suit, but he’s filed it on behalf of Virginia’s 49 Republican and 110 Democratic delegates.

It challenges a Virginia law that states: “Delegates and alternates shall be bound to vote on the first ballot at the national convention for the candidate receiving the most votes in the primary unless that candidate releases those delegates and alternates from such vote.”

The complaint reads: “The First Amendment to the United States Constitution guarantees delegates to the Republican Party’s and Democratic Party’s national conventions the right to vote their conscience, free from government compulsion, when participating in the selection of their party’s presidential nominee.

Nonetheless, Virginia law acts to strip them of that right, imposing criminal penalties on delegates who vote for anyone other than the primary winner on the first ballot at a national convention. That law cannot be sustained under the First Amendment or as a legitimate exercise of Virginia’s authority under the United States Constitution.”

“Based on these reports, Correll is concerned that voting against Trump at the convention may subject him to retaliatory litigation by Trump, Trump’s campaign, or other persons or entities associated with Trump, based in part on Section 545(D),” the complaint reads.

Correll’s attorneys filed an injunction declaring Correll will need protection from prosecution under the state law because he plans to vote against Trump at the convention.

“Correll, like many other Republicans, refuses to cast his first-ballot vote—or any other vote—for Virginia primary winner Donald Trump because Correll believes that Trump is unfit to serve as President of the United States. Yet, if he does not vote for Trump, he faces criminal penalties, including fines and imprisonment,” they write in the injunction.

He had a qualified contender who just (seemingly) suddenly dropped out, just before Rube flip flopped back in.

The lawsuit could very well win. Rights go to the individual over the rights of the organization. Even if he wins it will not change the outcome of the nomination.

If the story is accurate and it is indeed an actual state law, the suit could win. But I don’t think there are many (if any) other states that have such a law.

Generally, state parties can do what they want.

Anyone reading this that had not unregistered as a Republican is adding to the problem. Primaries are over. You can reregister back later but GOOe needs a clear message.

Excellent Idea.

The other action is to send Ryan and Preibus postcards indicating that if Trump nomination is stolen, people will stay home on election day so now down-ballot becomes a factor.

I am in IL, and I called Kirk’s office and said if he refuses to support Trump, I won’t vote for him. Sadly, most if not all IL GOP are actually GOPe.

I think you refer to Jolly. He ran because Rubio said he would not. Others then joined him in running...hard to know who would win in a fair election. South Florida is always accused of “stuffing the ballot box” for their guys!

These never Trumpers are pro Hillary Rodman for President. They should be deported with the illegal aliens for the evil they are doing to destroy the nominee. Wish they would just go over to the democrat party where their heart and vote really is.

Sending a “Message?” What’s the “Message?” That you support this frustrated “Cruz” supporter? That you support the #neverTrump crowd. That you support the GOPe that wants to block Trump. or that you support Trump?

I don’t get your message, and neither will anyone else.

Back into the clown car with ya! Your solution is non-sense and subject to a myriad of interpretations that serve only to confuse the issues.

Trump won fair and square. He is the only legitimate candidate. If Cruz doesn’t denounce this he should be the one that pays the cost in 2018.
