Does Trump Have the Law on His Side Against Cruz? Judge Napolitano Says No

On "The Kelly File" tonight, Judge Andrew Napolitano said that Donald Trump doesn't have a legal case to back up his claim that the Ted Cruz campaign committed voter fraud in Iowa and that the caucus results should be nullified.

"There's no legal basis for that - he's making a political observation."

There are two issues. They are the “shaming” mailing and the spreading of rumors with the purpose of hijacking someone’s votes. It’s hard to believe that either situation has been fully investigated.

Trump’s tactics have nothing to do with the law. He’s playing the media like a fiddle.

Make an outrageous claim against an opponent (e.g. Cruz) or a journalist (Kelly) and then watch the media for days provide him with free advertising that smears the party he’s attacked.

He’s getting 10 of millions in free advertising every time he does this.

Before it is over, I expect Trump will accuse RubioRINO of being a serial philanthropist who has platonic relations with his sister. LIV will eat it up.

It’s Carson who must investigate not Trump. I hope he does. I find it odd if the judge is saying nothing can be done about cheating. No wonder this country is a disaster!

Well it appears that the FEC is going to be investigating Cruz’s two loans at Citibank and Goldman Sachs. He has until March 8th to produce documentation showing he did not have signature loans. So hopefully those two loans are fully collateralized or he’s in trouble.

After what transpired in Iowa I’m not convinced Cruz worries too much about election rules.

what he’s doing is making sure everybody knows what the Cruz campaign did in Iowa with the Carson deal and the voter intimidation letters and then the voters of NH, South Carolina and Nevada can decide in the next few weeks if they care..

Carson: Well, I didn’t make that announcement. Uh, I guess somebody talked to … other people…

Reporter: Well, your campaign told the press.

Carson: You know, *I* didn’t say it, so don’t blame me. [laughing]

Reporter: But you’re here telling us that people should know what’s going on in their campaign and hold people accountable, I mean that’s [crosstalk]

Carson: Well, let me ask you this question, is it okay after being on the road for after three weeks to go home to Florida and get a fresh change of clothes? Or is that a problem? Does that make someone into an evil, horrible person?

..... So, to summarize:

Carson admits his own campaign staffer talked to the media and said he was going to Florida.
Carson takes no responsibility for the actions of this staffer.
Cruz staffer tweeted a media report based entirely on what the aforementioned staffer said.
According to Carson, Cruz should take responsibility for that staffer.


So Carson knew his campaign leaked this to the press. Then got angry that it snowballed from there.... He is kinda burrying the lead here isn't he.

And going home to get a change of clothes? Is Iowa or New Hampshire so rural that he can't send staff or go himself to buy some more clothes?

That seems like a good summary. And the fact that half the media concluded from the Carson staffer’s statement that Carson was putting his campaign on hiatus also makes it seem like the Cruz staffer may have just made the same reasonable conclusion. Carson is an odd duck, at any rate.

if Trump thinks some of his votes went to Cruz because of the dirty trick then he has as much right to as for an investigation as Carson IMHO.. they need to do away with the stupid caucuses to start off the nomination.. it’s always a cluster F in progress for one or both parties

hey he’s going to Florida that means he’s out of the race 5 minutes before his people vote in Iowa,, yeah that’s it.. that’s secret code for he’s bowing out and his voters are up for grabs.. and whatever you do don’t bother to call the man to verify you might not get the answer you want.. if you are wrong just apologize later

I may be wrong, but I don’t think Trump really believes that the Iowa election will be redone. It is his way of highlighting what happened, and it is a legitimate ploy. This is politics, as Cruz supporters say to justify Cruz’s sleazy deception during the caucus.
