Cumberland County man cannot keep his grandfather's World War II rifle because it is an illegal assault firearm, according to a Sept. 15 New Jersey Superior Court Appellate Division decision.
The New Jersey State Police seized Danny Burt's M1 carbine and 20 other firearms in April 2013 after a temporary restraining order was lodged against him.

How can a court overrule the official definition of an “assault rifle” from the ATF?
In my book they can’t. This should be overturned, but then I am not a lawyer.

No even close to being the first assault weapon.
Also, if I remember correctly, the M2 was an automatic weapon, and you would need a machine gun permit to own one.
It is a far cry from your standard GI issued M1.

I don’t know what toy is pictured there, but it ain’t an M2 carbine, except maybe in the mind of a Chinese video game artist. An M2 is an M1 with a selector switch.
