It’s not hard to fathom. The clerk, whom I admire, really has no case as an individual if Kentucky won’t back her. The state says it’s her job to issue the evil licenses.

Kentucky is violating Section 1 of the 14th Amendment imo. Section 1 expressly prohibits the states from abridging constitutionally enumerated protections, the 1st Amendment’s protections of religious expression and speech in this case.

14th Amendment, Section 1: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States [emphasis added]; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

And the reason that pro-gay activist justices are ignoring pro-gay activist states who are violating the 14th Amendment is because these justices undoubtedly know that the corrupt, post-17th Amendment ratification Senate will not lift a finger to work with the House to impeach and remove such justices from the bench.

Good ole 14th amendment strikes again!

It was never about gay marriage to me, just a backdoor dismantling of the First Amendment’s religious freedom and free speech provisions regarding those who oppose gay marriage.

The Supreme Court effed up with their earlier decision affirming gay marriage. It's the SCOTUS who made it impossible for her to do her job, therefore she should quit or be fired.

They didn’t get four, because the four realized that justice Kennedy will always support the homos. Therefore they would lose, 5-4, *and* establish a court precedent.

By rejecting the case entirely, it is not given a decision, like the vast majority of the 8,000 cases appealed to them each year.

Since her religious beliefs don’t matter, will that same thinking apply to Muslims? I doubt it. Only a war on Christians matters to the supremes.

I have been saying for a long time that we need to be forcing confrontations between Muslims and Liberals. One idea that I keep suggesting is to make up some anti-Islamic literature, put liberals names on it, and drop it off in Muslim Neighborhoods.

Awhile back, a bunch of atheists printed a comic book featuring a cartoon bible raping a woman. I said at the time, "we need to get our hands on a copy, redo all the pages with Koran's replacing bibles, throw in a bunch of Insults for Mohammad, and then drop that off around various mosques in their area with those Atheists names and home addresses listed on it. "

That Muslims would saw off a few heads of my enemies would not bother me greatly. This is how you fight a war.

If it provokes an Anti-Muslim backlash, well that's okay too. Getting your enemies to fight each other is a very good accomplishment.

The problem is that part of your job is against your religion. It’s like being the Mormon soda jerk at a soda fountain that just started selling booze. You can’t just say, “I refuse to serve booze. You have to find another job. A job that does not violate your religious convictions.

And I’m with everyone here regarding the depravity of the SCOTUS and, frankly, our culture. But the rules really are pretty clear.

It is not the 14th Amendment doing this insanity. It is judges just Like Taney who will "solve" an issue not in their domain, and "politically correct" politicians more concerned with reelection donations than respecting the constitution who allow this crap to continue.

The system has been gamed. It is not to blame on the 14th, it is us who allow this crap to continue. This why many people are responding to a guy like Trump.

Have you ever read the 14th amendment? It is an utter hash. It is an incompetent babble of feel goodism masquerading as law. Had it been better written, it could have accomplished the same objectives without all the damage it has caused.

But that's just it. The Supreme Court has now created a religious test. If you are a member of the Dominant religion, you can now no longer hold public office.

With a Constitution that ends with "year of our Lord" and exempts the President from working on the Christian Sabbath day, it is insane to believe there can be any ban to Christians holding public office. But now there is.

Being an employee is different. If you can’t sell birth control pills don’t work in a pharmacy. If you can’t issue lawful wedding licenses don;’t be a city or county clerk. If you can’t do abortions don’ work at Planned Parenthood, in the OR or leave and go to a catholic or methodist hospital. Rights don’t trump employer rules and services. If you are openly gay and living in a gay sexual relationship don’t teach at catholic school.

The fact that some one at Abercrombe and Fitch can wear a hijab is a violation of this long standing principle. Employers have the right to determine the products and services. Public agencies have to carry out lawful services. The court has ruled this to be lawful.
