“That’s because we have allowed lawyers instead of language professionals to interpret the Constitution of the United States.”
That’s because the Constitution is the “Law” of the land. Its not poetry. :-)
The solution is to purge the North East States from America. Let them have the Europe they so strongly desire.
Well, the Constitution is a legal document so it makes sense to parse it that way. The second amendment has two clauses but only the second clause matters in terms of setting forth the law. That’s because it contains the “shall” statement. The first clause has no “shall” and doesn’t positively assert anything. It’s just preamble with no legal effect.
“Layers ARE language professionals.”
Absolutely, back on the farm we had two dozen layers and they were not dumb clucks, no sir, language professionals every one;>)
IDIOCRACY actually is a documentary.
pa constitution:
The right of citizens to bear arms, in defence of themselves and the State, shall not be questioned
Oh that is good! Totally makes the point.
and i should add i do not nor will i concede that i need a second amendment to the constitution of the US to allow me to defend myself and my family by whatever means necessary. God has bestowed upon me that right. and what god bestows no man can take away.
we don’t need the second amendment. we have the god given right to defend ourselves and our families from whatever threat.
“Common sense” is purely subjective.
The Law isn’t right, wrong, commonsensical or anything else other than AS WRITTEN.....PERIOD!
We think it clear that the sections under consideration, which only forbid bodies of men to associate together as military organizations, or to drill or parade with arms in cities and towns unless authorized by law, do not infringe the right of the people to keep and bear arms. ... It is undoubtedly true that all citizens capable of bearing arms constitute the reserved military force or reserve militia of the United States as well as of the states, and, in view of this prerogative of the general government, as well as of its general powers, the states cannot, even laying the constitutional provision in question [the 2nd amendment] out of view, prohibit the people from keeping and bearing arms so as to deprive the United States of their rightful resource for maintaining the public security, and disable the people from performing their duty to the general government.Presser v. Illinois, 116 U.S. 252 (1886)
the constitution does not bestow rights. they come from god. all of my rights are mine and may or may not be allowed under some government instituted by man. your list however are not rights as you know. the list appears to be mostly medical procedures. and some other government created fictions. actually water might be a right as its abundance is god given. access as to how i get it is definitely dictated by government.
Per your comment:
Title 10 section 311
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
This is idiotic.
First of all, you would be hard pressed to find any public school teacher who could parse a sentence.
Second, the idea that a militia needs a law to be armed is silly. Was there a problem before with armies not being armed?
What it says is that for the militia to be well regulated, the citizens need to be armed.
Furthermore, every amendment in the Bill of Rights addresses an individuals right with the exception of the tenth. Why would every amendment be about individual rights and the second about state regulations.
Even if you buy the argument set forth in this article, then it is the states who regulate, not the federal government, which really did not exist when this was written.
Post of the thread.
These people are idiots. The founders made or clear why a 2nd amendment was needed and many of them said/wrote just that.
Read the documented draft versions. Very clear what they were getting at, which isn’t what the author says.
Do you think the leftists realize that The National Guard is part of the standing army?
The standing army is not the militia.
How much more clear do they want it? Do they think "people" means Martians or something? Do they understand the word "not"?
