There were five employees plus the sixth who was hitching a ride to NYC. ONE was the engineer, TWO the assistant conductor a woman who was in the last car and thought she had heard the conversation regarding the stone

Yes civil penalties only from the FRA, but in addition to those the railroads have additional penalties that very likely will get a violator fired.

The quick acceleration raises red flags for me. If he had just been distracted he would have neglected to slow down the train. To increase the speed you have to actually take action. Trains do not accelerate themselves. So why would he accelerate the train right before the curve?
The only logical explanation I can come up with aside from suicide is that he was unconscious and fell against the device that accelerates the train. I’m sure they already have any cellphone records of his calls at that time.
