Question: Anybody Know Why No Grand Jury Needed In Maryland?

Is it up to the states attorney to decide? Or are there some rules about when a grand jury is necessary.

Bottom line why was there a grand jury in Ferguson but not in Maryland?

A grand jury operated in complete secrecy, with sealed records and unnamed, but sworn witnesses. They have a lot of leeway in asking questions on just about anything relating to the case (people or organization who are subjects of investigation).

That is why the communists with their Coalition to Stop Grand Jury Abuse, waged a national campaign against federal grand juries investigating domestic terrorism. They knew that a DA often did not get all the answers to issues in a possible case that a grand jury could elicit because of their independence in asking them.

Whenever you hear someone suggest getting rid of the grand jury system, find out if they belong to the Marxist National Lawyers Guild (behind the Abolish Grand Jury movement) (It was created by the Communist Party USA back in the 40’s), or its offspring, the Center for Constitutional Rights. Don’t know if the parallel leftist ACLU is waging a similar campaign but they often join red united fronts rather than taking the lead on it.

There is also a Marxist black attorneys’ organization known as the National Conference of Black Lawyers, not to be confused with the legit National Bar Association, a black legal organization in its own right.

A grand jury is not necessary to obtain a filing. The prosecutor can make a decision about whether he/she thinks they have enough to obtain a decision. With the grand jury, the prosecutor takes his evidence to the grand jury, who decides if there is enough evidence that a jury might conclude the person is guilty, then they arrest the person. On a filing like this, I think they will hold a preliminary hearing where a judge will decide if there is enough evidence to continue with the prosecution. The biggest difference is the defense will be able to cross examine witnesses in the prelim.

Can you imagine if everyone charged with a crime had to be approved by a grand jury before charges were filed? It would be a horrendous log jamb.

While all states in the U.S. currently have provisions for grand juries, only half of the states actually employ them and twenty-two require their use, to varying extents. The modern trend is to use an adversarial preliminary hearing before a trial court judge, rather than grand jury, in the screening role of determining whether there is evidence establishing probable cause that a defendant committed a serious felony before that defendant is required to go to trial and risk a conviction on those charges.

The federal constitutional right to have federal criminal charges screened by a grand jury is one of just a handful of provisions of the federal Bill of Rights that does not also apply to state and local governments.

It’s different in every state. For a lot of states there can be direct charges and in other places there needs to be a grand jury indictment.

She issued a "Probable Cause Affidavit" which served as an arrest order. She has 30 days to convene a grand jury and seek an indictment.

An Attorney General, or a top prosecutor, can always directly bring charges. BUT, they usually use a Grand Jury, to keep politics out of the area. Here, the black slut WANTED to poison the Jury pool!

or if the fact that he has a record would preclude him from carrying a knife,

it appears that he was out on bail, awaiting trial in May for one case ... run when you see a cop look at you under those circumstances ... doesn't seem unusual that you may be taken in ... and original report says "switchblade" knife no matter what the states attorney said today.

Hmmm. I am not familiar with that original report. That is not something that I have seen.

I have also read somewhere that they had seen him involved in a drug deal or a suspected drug deal, but they din’t charge him with that or describe that. At least not that I am aware of at this time.

In Ferguson, a grand jury refused to indict. Mosby couldn’t take that risk.

Since the driver of the van is black, and he is the one being charged with the highest penalty, that wouldn't look so hot to the good citizens of Baltimore.

In fact, the driver is the one most likely to see jail time.

Again that spoils the racial grievance industry narrative.

A black cop taking the rap will not enhance her street cred.

Good question. I would also like an explanation as to why the press didn't report the last part of that press conference when What's-her-name said to save much time the trial would be this weekend, and would be held over there under that tree. Also, there was no effort to explain what she intended to do with that rope she was carrying.
