You would be surprised...I work in a college city and we get a couple of calls a week from parents out of the area wanting us to check on their kids because they haven’t heard from them in a couple days...so we are put In bad situations...

There is a difference between a homeowner with a gun awakened at midnight and an ‘intruder’.
I once got a called very late in the night from the Cobb County Police dispatcher. She told me the police were outside my home and were wanting to ask me if I’d seen a runaway teenage girl in the area. It was actually a very smart thing to do.

The police see an intruder with a gun who wont back down then the intruder is the bad guy, not the cop. Well, yeah, except that the old man was not an intruder. He was in his own home, facing what he thought was an intruder.
So actually, you have identified the wrong person as the intruder.
I have mentioned this on other threads. If cops are going to barge into a home, especially at night, they should be required to have a marked patrol car out front with lights flashing and siren on. Give the homeowner some kind of heads up.

The notion that a cop can enter your home to check on you without a warrant is making the cop the intruder. That's a very good point. If this sort of thing is allowed to stand, then there's nothing to stop me from calling the cops at 1 AM and saying "I think I saw blackdog just leave a bar. He looked really depressed. I'm afraid he'll hurt himself of someone else."
Then at 1:30 blackdog's door gets knocked in. Unpleasantries result.

When he goes over to check on a 74 year old man, the cop thought that another 74 year old man was burglarizing the house or something? Exactly. Cop should have backed out and tried another tack. Ego probably wouldn't let him.
