26 states are suing San Francisco over an ordinance on home gun storage

Attorneys general from 26 states filed a federal lawsuit against San Francisco on Thursday over an ordinance requiring locked storage for handguns, arguing it threatens the Second Amendment right to bear arms.

San Francisco firearms must either be stored in a locked container or with a trigger lock at all times in a home unless the owner is carrying the firearm, according to the lawsuit. The suit notes the ordinance applies even if someone is the sole occupant of their home or sleeping, which is dangerous for gun owners, the states say.

“Common sense dictates that in high stress, emergency situations, the ease and speed with which a person can utilize one of these mechanisms to unlock a safe drastically decreases,” the suit reads. “It is common to fumble with keys while trying to hurriedly unlock a door, to forget a series of numbers when under pressure, or to struggle with hand-eye coordination when subjected to stressors.”

Wisconsin Attorney General Brad Schimel (R) said in a statement the ordinance could set a precedent that “could influence policy decisions and court holdings” nationwide, which is why so many states signed on.

The States’ Attorneys General did not file a federal lawsuit against the San Francisco ordinance; they filed an amicus brief in support of the lawsuit filed by various parties who, presumably, actually have standing to bring the action (unlike the Attorneys General).

Your response beat mine. You have that exactly right - unlike the reporter.

A gun is like a fire extinguisher. When you need one, you need it RIGHT NOW and can’t be bothered to find keys to unlock it.

Didn’t the Supreme Court already decide this sort of case for DC in Heller?

Thanks for the information.

I was just going to post a question asking how a state would go about suing an out-of-state city over one of that city’s laws.

That is an horrible article. Even as leftist as it has always been, the WaPo at least USED to have writers who were not complete imbeciles.

...or a seatbelt.

I do not PLAN on getting in a car accident every time I drive - but I still wear a seatbelt every time i drive.

I do not PLAN on having a criminal attempt to rob/murder me every time I leave home - but I still carry a means of self-defense with me every time I leave home.

“It is common to fumble with keys while trying to hurriedly unlock a door, to forget a series of numbers when under pressure, or to struggle with hand-eye coordination when subjected to stressors —

With this law in place, cops can do a no-announce entry without fear. Any law-abiding citizen will have his piece all locked up, nice and tight, with no time to respond.

Oops, wrong address.

Well at least we shot a law-abiding citizen, not some poor maligned undocumented terrorist.

Good, good, now sue the ‘H’ out of California for demanding the other States adhere to the new, and ridiculous chicken pen laws that will cause Americans much grief at the market checkout for eggs, and anything, and everything made with eggs.

IF anybody thinks it’s only California, their delusional, because California law demands all suppliers in any state conform to the new stupid, ridiculous specifications for operating chicken egg farms. We used to pay $.99 - $1.29 a dozen, and already the prices exceed $2.29 a dozen. The law just took effect this month.

Went from $5.00 + change to just under $12.00 for the Costco 5 doz. flats in about a years time. Jumped from $8.00, and change a month ago to just under $12.00 early this week.

Yeah I know it ain’t second amendment, but I gotta rant.

Such a local law has absolutely noting to do with any other state.

Our State AG’s have no standing, and no business here.

In the late 19-nineties the Hearst’s paper in SF , with the knowledge of Corp Administration, made a deal with The Willie Brown (of SF and California legislator fame) that they would not oppose his election if he did not oppose Hearst’s acquisition of an competitor paper. He did not, they did not but someone objected and court case ensued.
In spite of the court case: They got their way, Willie got his way and the fall out was the public also found out the fellas of Hearst were willing to suck up with Democrat politicians. There is a lot of Brown in San Francisco and some of it is in Albany NY.
