Sen. Charles Schumer said President Obama should take executive action to change immigration policy because Republicans have refused to pass a reform bill.

“The president has no choice but to take executive action where he can, wherever it's legally allowed, to help reform the immigration system. We cannot put up with this constant obstruction. We need to fix our broken immigration system,” Schumer said Thursday.

I hope Obama gives an EO for immigration. I don’t want the Republicans touching it. And if it means that the Republicans are not going to work with Obama for the next two years....well that is just the cherry on top.

I think we should work with them on this.

There is a difference between immigration reform and amnesty.

We should take this opportunity to make detail immigration laws that take much of the discretion away from the administration. such as:

1. mandatory jail sentences for illegals.
2. mandatory jail sentences for government employees that violate the new immigration laws.
3. mandatory jail sentences for administrative officials that use hide, destroy, administrative orders to bypass the immigration laws.
4. No more deportations, Illegal immigrants will be kept in refugee encampments. (think tent cities) The criminal elements will be incarcerated in refugee prisons.
5. etc.

My understanding is that the only thing he can accomplish by the mechanism of an EO is to slow or stop deportations under certain conditions. As an EO it is subject to being rescinded by the next President on January 20, 2017.

The SCOTUS has consistently held that immigration policy is the exclusive province of the Congress, so Obama cannot by EO create new standards for citizenship or naturalization. He can only slow or stop the deportation flow as an enforcement matter.

I think the Congress should let him antagonize the voting public with such a move, while passing a comprehensive immigration bill designed to change the infrastructure and systems used to monitor immigrants and visitors to the US.

It makes no sense to debate a bill setting immigration quotas for various countries of origin, when in fact we have no way of monitoring any given number of visitors/immigrants from any country of origin.

Tighten up the systems and controls, then debate as a matter of policy what the correct number of Azerbazhanis, Uzbecks, Zaireians, Brits, Laotians and whatevers who should be allowed to enter each year.

Let Obama veto such an immigration reform (improving tracking, deportation, restricting asylum, etc.) And then serve up the issue piping hot for 2016. It's a winner.
