A state magistrate in Pasquotank County could face disciplinary action after refusing to marry two men following the end of North Carolina's gay marriage ban.
Magistrate Gary Littleton declined on Monday to perform the couple's civil ceremony, citing his religious views that marriage should be between one man and one woman. Under state law, a magistrate who fails to perform his or her legal duties can face removal or suspension.

These magistrates have been doing their entire job for decades, and this is the first objection. Why? Because it involved direct participation in an objectionable act.

The courts didn't rule, they legislated from the bench. They should be impeached and removed. A majority spoke and it is not up to courts to redefine marriage for political purposes.

we are in an age of court rule. And many judges are liberal or at least do their own thing.
We first ran across that in a major way in Cal when we passed prop187 prohibiting the use of state funds to provide benefits to illegals. When the appeals court overturned it, the new governor Gay Davis refused to appeal it and represent the vet of the people and we did not nothing. Now Cal spends $16 bill a year on illegals and they keep coming.
Short of a revolt, don’t know how we stop it. Cal is worse now than when we passed 187.
I agree with most everything you have written. But it is very frustrating that the courts have become so invovled/intrusive ... which ever side of an issue you fall on ... with changing the fudamentals of an existing law. Congress does this all the time ... ignore the will of the public. Now the courts are ignoring the will of the Congress and the will of the electorate. Where the hell do we go from here?

Judges rule case-by-case. AFAIK, they cannot nullify the law, as that is a legislative function.
Judges can rely on case law in order to rule, but their rulings are, AFAIK, supposed to be independent.

There is ALWAYS the option of Civil Disobedience; as long as one is willing to fight and stand-up to the consequences of their actions/fight.
The magistrate should say its a matter of Sharia Law and he can’t violate that.

It may be Basic Law 101, but I don’t see in the Constitution where the court has authority to create or destroy legislation.
Does jury nullification destroy legislation, too?
That’s what it all boils down to: Are we willing to sacrifice our jobs,our lives, even our reputations in order to faithfully serve God? This magistrate did what was right(even though resignation would have been my personal choice)and now he will be a victim of an un-American ruling. The more-tolerant-than-thou crowd of the left is imposing an un-American system on us.
juries don ‘t make law they decide on criminal and civil cases.
You need to do some work on your understanding.
You are confusing our view of what the courts do with their right to do it.
The issue with courts is who appoints judges because of the power they have.
