A state magistrate in Pasquotank County could face disciplinary action after refusing to marry two men following the end of North Carolina's gay marriage ban.
Magistrate Gary Littleton declined on Monday to perform the couple's civil ceremony, citing his religious views that marriage should be between one man and one woman. Under state law, a magistrate who fails to perform his or her legal duties can face removal or suspension.

case law is a law until or unless a higher court overrules it or the legislature passes a new law.
What is the religious test for the post? When you’re in a government post and the law change if you can’t live with it you either resign, get fired, or get it changed.
There is no expectation of the law to remain the same.
case law IS a law.
The only thing that will stop this is armed patriots standing guard outside the clerk’s offices. They will have the numbers to face down police. There is no other way.
your number 2. Good thing under your explanation Muslims don’t hold more offices.
There ya go.
NC didn't end the ban, the SCOTUS did. So why should be be suspended?
Good point.
case law IS a law.
So the legislature can just amend it?
Has a Catholic priest ever been sued for refusing to marry two divorced people? Has a Rabbi ever been sued for refusing to marry an interfaith couple?
Yes, bakers and catering-hall owners may have legal problems (although they shouldn't), but clergy are not going to get sued.
The guy is a hero. If the perversion lobby is going to push this obscenity, then maybe those who are rational and know morality (not to mention biology) should push back and ban homosexuality as it was banned before 1960.
In many cases the legislature can change the law and redirect from the issues considered by the court and in some cases not.
You have seen that in congress when someone proposes a change after a USSC case decision.
In this case best of luck.
But you cannot impose your religious belief on your employer or the populace if you are in a position governed by the laws and regulations of the state, local, or feds.
If you can’t abide something serious, resign.
“...but clergy are not going to get sued.”

Really?
Its just a matter of time. Ask xzins ( Retired Army Chaplain and Proud of It! )
I suspect he knows that military chaplains are facing religious persecutions right now.
And that idiot lezzie mayor in Houston might have failed (this time) in having pastors submit their sermons for approval. But it won’t be long....
How’s that expression go (aside of ‘by the wayside’, as it it these days): “All laws repugnant to the Constitution...”
Think we still have a 9th and 10th...somewhere.
I am not defending the appellate and USSC courts. Merely saying if you work in government you should follow the laws. Of course the hero of benghazi included.
Think about having some of the religions being followed in public office. Islam etc.
You sound like a liberal and this is a strawman. This country was built on Christianity and no other.
That wasn’t my point. My point was, because this was handled extra-legislatively, “getting the law changed” isn’t an option...not at the local level, at the state level, or at the federal level.
Number 2 is why the left is subtly trying to change the language of “free exercise” to “freedom of worship”.
Then, once they get there, you can’t express your religion outside of official worship services.
then the employee should quit or follow the law.
My point is every law change starts somewhere. Don’t know what thew future will bring but the gay marriage battle seems over and our side lost.
You always have a choice to follow your conscience or not. Just be ready to accept the consequences. But public officials cannot hold office and violate the law, unless they’re in the WH or congress, of course.
Imagine the consequnences on public services if every one followed their religious beliefs in their ministerial duties, muslims, etc.
