First Admendment "Free Speech" ... when practiced behind a "tax-exempt church pulpit".
Period.
I openly challenge the deceptive ADF organization (and you, gentle reader) to DOWNLOAD IRS Pamplet-1828 ...
and send this legal copy of the "Federal Contractor Guidelines" to EVERY Christian Church in Houston, Texas.
I maintain that the ADF's goal is "financial gain" ... as they "lie through their teeth" to otherwise well-meaning Christians about church political activity.

The city of Houston has issued subpoenas demanding a group of pastors turn over any sermons dealing with homosexuality, gender identity or Annise Parker, the citys first openly lesbian mayor. And those ministers who fail to comply could be held in contempt of court.
The citys subpoena of sermons and other pastoral communications is both needless and unprecedented, Alliance Defending Freedom attorney Christina Holcomb said in a statement.
The city council and its attorneys are engaging in an inquisition designed to stifle any critique of its actions.
ADF, a nationally-known law firm specializing in religious liberty cases, is representing five Houston pastors.
They filed a motion in Harris County court to stop the subpoenas arguing they are overbroad, unduly burdensome, harassing, and vexatious.
Political and social commentary is not a crime, Holcomb said. It is protected by the First Amendment.
The subpoenas are just the latest twist in an ongoing saga over the Houstons new non-discrimination ordinance.
The law, among other things, would allow men to use the ladies room and vice versa. The city council approved the law in June.

So the government decides what a Church may say? The government can dictate to a church that certain biblical passages are not protected speech?

But the Marxists/atheists are in control. As they, as planned, control our educational system and media, our nation is predominantly dumbed-down and brainwashed - and the percentages of such are only on the increase. Until we have a solution for dealing with the root of their brainwashing, their numbers will only increase.
I believe only a collapse and revival of truth (a Christian world-view, and personal revival) can change things.
So the likelihood of our changing the status quo on tax law is nil.
I’m saying that there is another way around this - if only for the present situation. Even if not tax-exempt, every church should show zero profits, leaving themselves only subject to property taxes, sales taxes, etc. These should not impact true believers in any significant way.

And you come across with almost irrational hatred of ADF - and your arguments don’t work.
As stated - pastors can continue to claim 501(c)3 status AND preach the gospel and allow the IRS to attempt to enforce the regulations that you claim are solid law. As stated elsewhere - the IRS has repeatedly REFUSED to bring a case forward, because they know that they would LOSE it.
In the same manner - whenever I am contacted by the Census Bureau - I refuse to answer ANY questions except how many people live at my residence. They want all sorts of additional data and they quickly cite various ‘laws’ that mandate my answering them. I tell them to take me to court, because there are plenty of non-profit organizations that are LOOKING for a chance to challenge those laws in court. There is a thing called ‘STANDING’ - and these non-profit legal organizations can’t challenge the law by themselves...they need someone who is being ‘injured’ by the law. So the Census Bureau uses the regulations/laws to coerce compliance - but they won’t actually allow any case to proceed so that no one has standing to challenge the law. If challenged and the courts find that the laws/regulations are an un Constitutional invasion of privacy, the Census Bureau would no longer be able to coerce compliance from the majority of the people the can be coerced.
In the same manner - the IRS will fold like a cheap suit if they tried to actually enforce the regulations and thus give ‘standing’ to a pastor, and then ADF can step in and actually assist in overturning the regulations.
You - on the other hand - want to cripple churches - and your irrational declarations won’t stand critical analysis.
There are similar clauses for general corporations. Roy Cohen got nailed for claiming a $100,000 yearly income/salery from his corporation but enjoying a million dollar a year corporate expense account which he didn't claim as personal income.

So, the government will decide what churches can preach, what biblical passages must be ignored otherwise they will be ‘influencing legislation.’
ANY preaching that addresses moral issues, such as homosexuals and abortion, WILL affect legislation, therefore, the government can ban those churches, penalize them for preaching the Word of God.
If they are not tax exempt then the church has to pay the government for the right to exist (collection plate takings. . .taxed, church soup kitchens, taxed, clothes for the poor, taxed, etc).
If they are tax exempt then they can’t say anything because church teachings are MORAL teachings, and government laws and regulations many times are moral issues.. .so, what’s left if you can’t preach what the Bible says?
Canada and their human rights councils and the UK arresting street preachers. . .they are long gone. . .but in the US, we have not lost yet, unless we cave in and not fight back.
Government will lose and lose badly if they try to silence churches and the Word of God.

If Satan’s minions cannot win by using “tax exempt status”, then they will use zoning ordinances.
That concept does not appear anywhere in the Constitution. It was a line in a letter written by Thomas Jefferson to the Danbury Baptist Church in defense of the First Amendment. The Supreme Court did not start redefining, revising and dismantling the Founder's conception of Freedom of Religion until the last half of the 20th century, and their decisions have been snowballing since then.
