The IRS scandals: An evidentiary note

Yesterday on FOX News Sunday Chris Wallace invited Washington superlawyer Cleta Mitchell and reptilian Democratic hack Julian Epstein to discuss the IRS scandals in the context of the “lost” IRS emails. More than one scandal inheres in the events, including Obama’s declaration of innocence regarding those involved; I therefore refer to the IRS scandals. The video of the FOX News Sunday segment is below and is worth a look if you haven’t seen it.

At 2:30 in the segment Wallace displays a Missing Emails Timeline depicting a point made by Kim Strassel in her Wall Street Journal column of this past Friday. The segment is worth a look for the timeline all by itself. It shows that Lerner emails were “lost” a few days after House Ways and Means Committee Chairman Dave Camp asked sent a letter to the IRS inquiring about the targeting of conservative groups.

“The timing was coincidental,” Epstein asserts on the basis of no facts whatsoever. *snip*

Epstein implies that only direct evidence is “hard evidence.” This is simply not the case. Direct evidence can and frequently is far weaker than circumstantial evidence. *snip*

Epstein is an attorney and he knows all this. His job is to blow smoke. He blew smoke in great quantities during the FOX News Sunday segment.

This is a great segment to watch, the video is at the link. Watch it if you can, it's worth it. The article explains a bit about evidence, and shows what Cleta Mitchell (the dems worst nightmare) stated as stipulated fact in the interview. She's a pit bull, and one of the reasons this will continue to break bad for the administration. This isn't going away any time soon.

Shazzam Gomer!

That is one BIG dog that ate 6 computer harddrives that had random crashes, but just happened to be the 6 people under investigation, then the dog ate 3 off-site backup sites for the IRS redundant emails servers, then the dog abruptly ate the contract with SonaSoft email archiving company following the 6 "random, ooops, giggle" personal computer hard-drive crashes.

The dog will eventually have to take a huge dump on Congress, but who will pick through the poop to find the real evidence? Holder? Nope. Justice Department? I don't think so....

Gibbs Rule 39 has been stretched to its limits. We don't need no stinkin' investigation.

The DOJ and the administration will never give out the incriminating evidence, they're too lost in criminal wrongdoing to stop now. It's only going to be won by lawsuits brought forth by pit bulls such as Cleta Mitchell.

Watching her, it's kind of heartening to know we have someone this tough on the case.

No one has the power to stop the DemonRat/Media/Bureaucracy complex any more, not even the people picking up the tab.

We are all IRS slaves until the final collapse in about 2.5 years.

I’d never heard of Cleta Mitchell before, but I googled her and, yes, she does look like what’s needed for this.

I’m amazed at how brazen and in your face these IRS people are. That means either that they know Obama has the power to put an end to the whole thing and will do so (probably by arresting half of Congress) or - conversely - that they’re terrified and feel the best defense is a good offense.

This goes beyond firing and loss of pension, all the way to serious jail time, and they know it. And so does their boss.

You are right... Cleta Mitchell is terrific and a treasure for our side.

What is so exasperating is that the Democrats are completely mis-representing the C-4 law: donations to C-4s are not tax exempt for the donors. And C-4s can spend up to 49.9% of their time and $ on political activity. So these efforts to undermine the C-4s and marginalize their efforts is just pure partisan posturing and illegalities ACCORDING TO THE CONSTITUTION OF THE UNITED STATES.

I think it likely that the Camp letter triggered the email destruction. It alerted Lerner to the possibility that there might be an investigation into the use of the IRS to oppress political opponents of Obama.

Lerner probably rushed to destroy the evidence before any actual governmental investigation commenced, in order to avoid later being charged with obstruction of justice by destroying evidence.

She probably thought that if she destroyed the emails before an investigation started, she was safe.

However, she was probably not aware that Sarbanes-Oxley expanded the crime of obstruction of justice, and now you can prosecute someone for destroying evidence even before an official investigatory proceeding is underway.

The law was meant to give the government more ways to go after businesses, being able to claim that discarding or shredding documents is a crime even before any possible investigation of wrongdoing has started.

The problem for Lois Lerner is that the law is not limited to businesspeople, but technically would cover her destruction of email.

Perhaps the courts will help her out by ‘rewriting’ the law to exclude government employees, or at least Democrat government employees.

Heck, if only a quarter were that good I'd take it.

I do like the doggedness of this woman (and Trey) as well. Having a pit bull alongside her obvious quickness is just what this scandal needs. When she says she's taking them all to court, and that's how we're going to find out the whole truth, it just makes me grin ear to ear......

Lerner is a Lt in the Obama crime family.

We need to put the Lts behind bars. Some of them will give up the capos and maybe someone will give up the Don. Otherwise let them rot in prison and watch stories about their hero playing golf.

I seem to remember Julian Epstein appearing on TV a lot during the Clinton years.

He struck me as a particularly venomous person.

Interesting that he's showing his face again.
