Liberal Judge: My Reverse Racism Made Me Convict White ‘Killer’

Retired Brooklyn Supreme Court Judge Frank Barbaro wants a white man he convicted in 1999 of killing a black man to be freed — claiming Wednesday he based the verdict on his own reverse racism. The 86-year-old former jurist convicted Donald Kagan, now 39, of fatally shooting Wavell Wint, 22, during a struggle over Kagan’s chain outside an East New York movie theater in 1998. But Barbaro told a court that, because of his viewpoint as a civil-rights activist, he didn’t consider a justification defense by Kagan in the nonjury trial. “Mr. Kagan had no intent to kill that man . . . I believe now that I was seeing this young white fellow as a bigot, as someone who assassinated an African-American,” Barbaro, a former longshoreman who also served 23 years in the state Assembly, told Brooklyn Supreme Court Justice ShawnDya Simpson. Barbaro said he contacted Kagan’s attorneys after some deep soul-searching led him to realize he had denied Kagan a fair trial.

There is nothing “reverse” about it.

It is simply racism.

Apparently the “only whites can be racist” syndrome is, in the minds of many blacks, an absolute.

There is no such thing as reverse racism; racism is racism. The color of the target reverses nothing.

Anyhow, if a new consciousness of God comes upon the world, I would expect many more conscience moments like this.

Calling it reverse racism is in itself an admission of sorts.

He doesn’t see it as pure unadulterated racism.

RED FLAG!

I've having trouble determining what that means. But yes, reverse racism seems to be a real problem these days, not racism as liberals imagine it in their heads.

And the weird thing is most anti-black whites were not Republicans. Liberals dug themselves in this hole then they blamed other people.

Tom Wolfe wrote a book in the 1980’s about how those in the justice system in NY were looking to convict white defendants regardless of guilt. It was called Bonfire of the Vanities.

There are a large number of people in government willing to accuse white people of racism regardless of the truth. This judge felt guilty about it very late in his life. Most government employees never feel a bit of guilt.

I agree. Most folks don’t know that the Great Society programs passed under Johnson, couldn’t pass in a majority Democrat House and Senate, without a contribution to the effort by Republican members.

When the worst of racism was taking place under slavery, the Democrats had a solid lock on the South. Faubus, Wallace, and a lot of Democrat office holders were pro segregation and some were former members of the KKK.

Or it might be that at age 86 the judge was afraid he was not long for this world and about to face the final judgment. He wanted to atone for his sins before he died.

This expressed opinion of the Judge changes nothing. Maybe he’s close to death, so is trying to come clean about past transgressions. Only a new trial would change the sentence, and I did see where anyone is trying to re-open this case. If this trend were to catch on, no verdict would ever be accepted as final. Lots of time and money would be spent on court costs to re-try everything. A judges’ authority would be greatly diminished.

yes...that was my first thought. He probably got a call from his doctor with the results of the tests.
