Sen. Lindsey Graham (R-S.C.) predicted Sunday that the Supreme Court will send former President Trump’s immunity case back to the lower courts.
“Well, I think the court’s gonna find that presidential immunity exists for President Trump like every other president, but you got to be within the scope of being president. I think they’ll send it back to the lower courts to find out exactly what actions fall within presidential immunity and what are considered personal. I think that’s the way this will end — there will be some immunity for some of the actions,” Graham said on CNN’s “State of the Union.”

Obama is out of office. He committed lots of actual crimes, the first being his "birth certficate." When can we go after him.

Huh? I think that is the general opinion of almost every Constitutional legal professor that is not totally biased to the left. I don’t think the Democrats are going to get Trump to trial on any of the Fed cases before November.
Democrats should have filed these cases sooner but they waited until what they thought was prime time to have Trump convicted in late summer or early fall. They assumed all the judges along the way would fall in line with them, SCOTUS wouldn’t get involved, and it would be a slam dunk. That’s just not happening (See the Florida case for another example).

I don’t understand the point of the S.C sending anything back to the lower courts, it made it to the top court now MAKE A DESCISION.
It sounds like the way the court conservatives were going is the decision will be more definitive than that and hold any decision he makes as to carrying out his official duties whether motivation is policy or political is immune and his motivation is not material, even if it has to do with contesting an election and employing tactics that will benefit him as long as the tactics are legal, regardless of how one feels about the ethics. That pretty much leaves Smith with the ridiculous count that Trump led an insurrection with a guy in Viking horns as his general in raiding the Capitol to overthrow Congress and the government. Good luck with that. This also leaved Foni Fani’s Georgia case in jeopardy

The Supreme Court will not send the case back to lower courts since they would have to face the same case again.

Every time they pass on a strong stand, they encourage more of this bullshit. And a case involving a president should be handled AT the Supreme Court, not some lower judge where 3/4 of them are foreign born in dealing with Trump.
It’s literally what the Supreme Court was designed for.
Hope they don’t send it back to the same kangaroo courts whose bias triggered the original case.
