Court Tosses Jan. 6 Sentence; Ruling May Impact Other Cases

A federal appeals court on Friday ordered a new sentence for a North Carolina man who pleaded guilty to a petty offense in the Capitol riot — a ruling that could impact dozens of low-level cases in the massive Jan. 6, 2021 prosecution.

The appeals court in Washington said James Little was wrongly sentenced for his conviction on a misdemeanor offense to both prison time and probation, which is court-ordered monitoring of defendants who are not behind bars.

Little, who entered the Capitol but didn't join in any destruction or violence, pleaded guilty in 2021 to a charge that carries up to six months behind bars. He was sentenced last year to 60 days in prison followed by three years of probation.

He plead guilty. If you believe you guilty, I have no sympathy for him. I’m shocked it was appealed at all.

There may very well be a few...or even more than a few...who truly deserve jail time.Perhaps even serious jail time. But the vast majority of those who were there deserve,at most,a fine.

Of course The Big Guy's Department of Just Us operates under different rules when it comes to Presidential relatives and certain Republicans and their supporters.

You are showing that you haven’t been keeping informed on what the J6 protestors have been through. If they don’t “confess” to a lower charge, they will be accused of MUCH greater charges ... and because the system is against them, they could end up 20 years behind bars. It’s really a mess.

Are you serious? Haven’t you seen how the government threatens to destroy your life, your family, bankrupt you if you don’t plead guilty? Have you not seen how the government is allowed to lie to you to break you? Deprive you of sleep, throw you in solitary confinement if you don’t confess and plead guilty?

I assume you're typing from prison for leaving your trash cans out to long when it was your chore to bring them in when you were 5 years old?

Mark Levin was talking about this on his show the other day, but have we heard about ONE case being prosecuted of those involved in the 2020 riots? Of those involved in the DC riots when Trump was being inaugurated in 2017? I cant think of ANY, yet all we hear about is Jan. 6th Jan. 6th Jan. 6th Jan. 6th

Doubling down on stupid.

Eight other posters on this thread trashed your initial post - because they know that if you defy the feds, the feds go for the MAXIMUM sentence, as an example for all the other peasants.

Since their conviction rate is in the mid-90s [even outside the DC Swamp], pleading not guilty is a fool's errand, unless you're a billionaire with lots of lawyers.
