Colorado Law Raising Age to Purchase Firearms to 21 Blocked by Court

On April 27, 2023, Governor Jared S. Polis of Colorado signed Senate Bill 23-169 into law. The bill increased the required legal age of a person to purchase firearms from 18 to 21, preventing people under 21 from legally purchasing firearms.

Exceptions were provided for people in the United States armed forces or peace officers. The bill was challenged by the Rocky Mountain Gun Owners (RMGO) with two individuals plaintiffs in April, then amended in May. The RMGO and other plaintiffs asked for a preliminary injunction to prevent enforcement of the statute while the case is undergoing adjudication on July 7, 2023. Judge Philip A. Brimmer of the United States District Court for the District of Colorado issued the preliminary injunction on August 7, 2023. Judge Brimmer ruled the right to keep and bear arms necessarily included the right to acquire arms. He concluded there was no significant historical record of United States governments prohibiting 18-20-year-old people from acquiring arms.  From the opinion:

Several courts have ruled that the right to keep arms necessarily includes a right to acquire arms. See, e.g., Teixeira v. There were no prohibitions on teens acquiring firearms at the time of the ratification of the Second Amendment.

They want 16 year olds to vote but they can’t buy guns, smokes or booze. Liberals do too many recreational drugs to run a country properly. America is a mess right now. I personally believe America will never be able to come out of this. It’s done.

There were no prohibitions on the types of firearms either. For instance people could and did own cannons. Contrary to Bidens BS.

Of course the “old enough to go to war” argument will be met with “the military trains soldiers how to and when to shoot”. But they’re old enough to vote and to have an abortion or sex change if they like without parental permission.

As said many times here before, there was very little or no violence in public schools when clubs like these were common (Seattle area, 1942).

I grew up in south Georgia. Every guy in school had a Buck knife on his belt. Every truck in the parking lot had a rifle and/or a shotgun in the back window.

Somehow, no one ever got shot or stabbed.

A Constitutional right which clearly “shall not be infringed”. And they go and pass a law which clearly infringes it. Then they add exemptions, so that some people actually retain the inalienable right, but most people ... not so much.

Gosh. It’s like our Masters think they can just do whatever the heck they want.

I had to pass a gun safety course to get my hunting license. I did so well, I put my target card on the refrigerator...just like a little kid. I was a young woman of 18. lol

Exactly! I can't see blocking someone old enough to be sent to war from buying a firearm, or a beer, or whiskey.

Same here in northern ND. I recall trucks parked at the bar in the cold of winter with engines running, doors unlocked and guns hanging in the back window. Nothing ever stolen.

As a kid I watched the bang bang shoot’em up cowboy shows and was shooting a real gun in my early teens. At 16 I bought my own 22 rifle. I knew not to point a gun at a person or shoot them. Gun safety was some how or another just common sense back then.

The left has turned our culture into a lawless one where on one hand they do everything possible to create a criminal friendly atmosphere and on the other do everything possible to limit self defense.

The only one in which an automatic weapon was used that I can think of is the Valentine's Day Massacre. Although it wouldn't surprise me if MS-13 gang bangers illegally (didn't pay for BATF stamp) have full auto.

That is not a question, that is a statement, and I'm not going to "explain".

On another note, my dad knew Sam Nunn, and could have gotten me an appointment to the Naval Academy. I chose to enlist in the Marine Corps instead, and am still happy with that decision.

There’s been many darker days before and there’s been many state the same thing, yet here we are and everyone on the planet wants to live here…yes, it sounds like we’re done…please go educate yourself AND if you’re a male, get your low T treated. America is far from done.

Just want to comment that this gun group should be viewed with suspicion and not actively supported.

Rocky Mountain Gun Owners is a dudley brown gun group, along with national association for gun rights, and many entities that are all dudley brown creations.

The organizations tend to be grifters, and have actually tried to impede other gun organization’s efforts to advance the 2A, so they can get credit for trying to do so later.

There are many articles out there about the groups, if you search for them

Plenty old enough to serve as cannon fodder in a foreign war to help rich people get richer.

Prior to the Gun Control Act of 1968, people could (and did) buy guns through mail order, with the shipper neither knowing nor caring the age of the buyer as long as the check cleared.

Also prior to that act, you could walk into a store and buy a gun for cash without needing to give ID.
