Ninth Circuit Throws Out Berkeley Ban on Gas Stoves

The U.S. Court of Appeals for the Ninth Circuit tossed a Berkeley, California, ban on gas stoves on Monday, saying that the federal Energy Policy and Conservation Act preempted state and local authorities in regulating natural gas.

The Courthouse News Service reported:

The three-judge panel’s ruling reverses a federal judge’s dismissal of a lawsuit by the California Restaurant Association claiming the Energy Policy and Conservation Act preempts the San Francisco Bay Area city’s ban. The group said the ordinance would affect chefs’ ability to prepare food the way they are typically trained — using natural gas stoves.

That’s also the eventual fate of the ridiculous proposed Communist regulations from CA energy utilities (taxing users based on their income, rather than on actual consumption).

Years ago the court threw out a state ban on foie gras. Said the state was interfering in interstate commerce; food regulations are federal domain... something along those lines.

I think that story has been misreported. I could be wrong, but there is no possible way that energy costs will be capped at $15-$180 a month. People would run their air conditioners all day long! They’d do laundry during peak usage hours!
That proposed fee has got to be about what they charge for the access to energy, a separate line item on the bill apart from the price you pay for kWh usage.

Berkeley, the original California home of socialists, communists, and totalitarian rule. I abhor Berkeley and anyone who supports it, including alumni. They are Marxist to the bone, and wake up every day thinking of some new way they can make traditional Americans more miserable.

I don't understand how they even get out of bed with hate as their first thoughts. What an awful mentality they have.

I would think the left will appeal to an en banc hearing of the 9th circuit, so this isn't quite over yet.
