Trump names new lawyers for impeachment defense team

David Schoen and Bruce L. Castor, Jr. will head the legal team for the second impeachment trial of former President Donald Trump, his office announced Sunday, a day after CNN first reported that five known members of his impeachment defense team had left.

One point of friction with his previous team was Trump wanted the attorneys to focus on his election fraud claims rather than the constitutionality of convicting a former president.

Trump has struggled to find lawyers willing to take his case as he refuses to budge from his claims of election fraud which has been a serious sticking point.

With almost all the election result suits claiming fraud were lost in court, how come so many of the judges that allowed this to happen were Trump appointees?

The truth is that many of these "conservative" judges are quite hostile to individual rights. Conservatives don't want judges legislating from the bench and making up new "rights", redefining marriage, etc. However, many of these judges think that basic rights, like the right to vote, have that vote counted, and not be diluted or canceled by illegal or fraudulent ballots, are just little technicalities to be finessed. Their attitude is "the peasants are revolting", and many of these judges came from a list from McConnell. So, we get opinions about lack of ripeness, standing, laches and mootness. Some cases are still pending, and perhaps we will see some surprises.

I think Trump sees this as the last chance to expose the cheating. I applaud him for trying. Roberts made it easy for him to just declare it the farce that it is but he knows if the cheating stands honest elections are finished As usual Trump is alone.

Fixing the integrity of future elections is more important.

Would this work? ‘Millions’ of complaints/verifying sent to his lawyers to show in court that they DID vote for President Trump.

Note that nowhere in the article does it back up this claim:

There is one big problem with Trump's defense pointed on voter fraud. That is, with Roberts sitting this out and the Dems putting in uber lefty Leahy to preside on the issues and evidence raised, how do they think this will get on the record?? I can hear the decisions as they go along, Object for relevance, agree, questions denied. Bad move IMO. Worse if Trump thinks his points will get into the fake news, not going to happen.

I suspect they probably felt that even if there was a law that did not allow the mail in ballots, that “Exigent Circumstances” would have been an accepted argument given all the Covid issues involved. As an 82 year old I sure would not have wanted to stand in a line for several hours waiting to vote, not to mention risk getting Covid if people were not wearing masks and distancing. So far still well and would prefer to remain that way, not to mention alive.

I disagree. I think the unconstitutionality of the impeachment is a no brainer and a slam dunk for President Trump. Senate Republicans have already signaled that he will be easily acquitted if he argues on that basis.

They are basically offering him a not guilty verdict in exchange for keeping his mouth shut about the stolen election.

Which is EXACTLY why he should not take the bait.

He should use this platform to make the case that the election was stolen and that top Republicans helped steal it. He should present it himself, in detail, on the Senate floor.

If he does this, it will be the most widely watched TV show in history and it will be very first time that the American people get to hear the truth about what really happened.

If the Democrats and Trump hating RINOs really believed there was no evidence the election was stolen, they would jump at the opportunity to have President Trump come and “make a fool of himself repeating his crazy conspiracy theories” on live TV. That would be the coup de grace.

But they don’t think that at all - they know there is powerful evidence and that is why Lindsey Graham is running around trying to “warn” President Trump not to even mention election fraud “if he knows what’s good for him.” He and other top Republicans want Trump to take a fall - they will let him win by a decision if he agrees not to use the knock out punch.

President Trump should not take the deal - he should fight - if they let him speak he should use the platform to accuse them of stealing the election.

This is the nub of the problem. People love Trump because he breaks the rules. We live in a society based on the rule of law. Should we stop living by the rule of law, or should people who don’t like the rules move to a country that agrees with that lack of a code?

This is the nub of the problem. People love Trump because he breaks the rules. We live in a society based on the rule of law. Should we stop living by the rule of law, or should people who don’t like the rules move to a country that agrees with that lack of a code?

Show me the rules (Laws) that the lefties follow. I say fight fire with fire. When one plays by the rules and the other doesn’t you lose, just as Conservatives have been doing for years. The loses have mounted up and it is time to stop talking and do something to correct the apparent problems.

If Trump replaced his lawyers because they wanted to focus on the unconstitutionality of the impeachment rather than election fraud, then why does his press release mention only the unconstitutionality of the impeachment and not election fraud?

Maybe his new lawyers talked some sense into him, or maybe the original story was BS.

A televised trial in the US Senate will provide the opportunity for Trump to make his case for fraud, and for Democrats and their media enablers to be exposed for stealing the election. Once the televised trial is confirmed don’t be surprised if the Dems fold their tents and run for cover.

Testimony of witnesses and receiving of evidence does not usually occur before the whole Senate. Pursuant to “Rules of Procedure and Practice in the Senate When Sitting on Impeachment Trials,” Rule XI, that occurs before the select committee of 12.

Arguments are made before the whole Senate after the record of evidence and witnesses is provided to the main body by the committee of 12.

This Senate procedure was upheld by a unanimous Supreme Court in Nixon v. United States, 506 U.S. 224 (1993).

Personally I wish that all the thousands of people who went to D.C. on 1-6 could send a statement claiming not guilty of insurrection. They were there to give support to their President and to let America know that they will continue to support him. Who would they send such statements?

Trump ought to see the phenomenon @ work here: It is an unavoidable admission of the guilt of the Democrats for them to attempt to put on trial, to impeach Donald Trump. By “guilt” I mean the brazen apparent theft of the office of the president and of the vice president of our beloved homeland.

What a competent man such as Trump may do is to point-out the Democrats’ (inadvertent) admission that he is in fact the president, demonstrated by their determination and act of trying him for something that is obviously intended for a sitting office-holder.

Then he simply moves on to defend himself from the preposterous charge that he incited a riot or an insurrection.

(Aside: what a delicious charge: “He incited a riot!”)

It will not be hard at all for president Trump to prove his innocence in this matter during the upcoming “impeachment trial of the president of the United States of America”.
