Supreme Court punts, denies Trump immunity but blocks House Dems from tax docs

The Supreme Court on Thursday ruled that President Trump is not immune from a subpoena over his financial and tax records to Democratic Manhattan District Attorney Cyrus Vance, Jr., -- and declined in a separate case to issue a definitive ruling on whether congressional committees can have access to Trump's financial records, throwing both issues back to lower courts.

Vance had subpoenaed Trump's records as part of a criminal investigation into potential wrongdoing by the president and his organization. Multiple House committees had subpoenaed Trump's records ostensibly as part of an effort at oversight and to inform potential legislation.

"President is neither absolutely immune from state criminal subpoenas seeking his private papers nor entitled to a heightened standard of need," Chief Justice John Roberts wrote in the court's majority opinion in the New York case. The court limited its ruling and the arguments before it to whether Trump has "absolute immunity" and state prosecutors are required to show a "heightened need" in order to obtain documents as part of investigations into a president.

The president "may raise further arguments as appropriate," in lower courts in an effort to keep Vance from obtaining his documents, Roberts wrote.

Roberts also authored the opinion in the House case.

"Without limits on its subpoena powers, Congress could 'exert an imperious controul' over the Executive Branch and aggrandize itself at the President's expense, just as the Framers feared," he wrote.

The rulings, in the near term, represent a partial victory for the president -- he will not have to turn over financial documents in the midst of a fraught presidential election.

Given all the leaks of people in government who hate Trump if there was really incriminating information in Trump’s tax returns it would have been released by the press by now

90% of the people at IRS probably hate Trump and could get the returns if they really wanted to

Hell the IRS has all that info. I’m sure if it was damaging it would have been leaked his first month in office.

The problem is that a leak like that would have destroyed the ability of the IRS to demand unequivocably your financial information.

The various governmental agencies that are tasked with the confidentiality of the data of the citizenry take that job VERY seriously.

If citizens can prove that the government agency is lying about confidentiality, it's all over but the shouting.

If opponents can snoop on opponents by looking at tax returns, everyone and every business in America is at risk of being hounded and harassed this way. This is a bad decision.

Your tax forms and the attached schedules tell every secret about your life and business. Letting anyone other than the tax man review you taxes is bad. The tax man has that power but is told by law not to reveal your info except for valid prosecutions for tax fraud or evasion. Now, with this decision, any jerk who can get a local corrupt DA to start an investigation can ruin you.

They can subpoena him and his documents all night long. Doesn’t mean anything will be turned over. Appeal, appeal, appeal. Butt, knowing the commies/socialists they’ll simply, once again, claim he’s hiding something and the lame stream will be right there with them. If there’s no evidence of criminal activity, the should not see the light of day. NO FISHING!

It's out of Presidential politics now, which is correct as that is the sole reason the Dems and Dem prosecutors are requesting them.

As has been mentioned here before me, the left has no real interest in the actual finances involved. What they really want are names of businesses and individuals mentioned as debtors and contributors. Then they turn the ‘cancel culture’ on those folk and instigate SLAPP lawsuits to harass the Trump financial empire.

It is as Rush has said many times, the left simply wants to ‘punish’ DJT for getting into politics at this level. PDJT has caused an interruption in the flow of ‘rice’ into the political left’s rice bowl and now someone has to pay.

I don’t think anything will be handed over before the election. The fact that Pelosi just spent less than 30 seconds speaking about the decision tells me she knows they failed at an attempt to make this a meaningful impact on the election.

You can bet on it. As soon as the Prosecutors in New York get a hold of them, they'll leak everything to the NY Slimes. You may be right but that can't happen until the arguments to be presented by Trump are heard and adjucated. The case that went to the USSC was about whether or not the Congress and the State of NY were entitled to the financial records. Now Trump gets to argue why the State should not have them and what if any of them should actually be turned over. These arguments can take YEARS to happen and nothing nwill be released by the State of NY because they won't have them.

The august Supreme Court is dead wrong on immunity. The justices fell for the fictitious argument application to the presidency that no one is above the law.

The Constitution provided for the removal of a rouge president committing illegal acts by implementing the impeachment process.

Going forward, it only takes a few false witnesses to completely tie a president’s hands, such as Cohen, and he is by himself.

this SDNY decision was just for an IMMUNITY claim...smart delaying tactic by Trumps lawyers, a whole year. Now, the process starts about what they actually can get...which means first to the District, then Circuit, then Appellate Courts etc....the Congressional attempt was a complete Trump beat down....these were both political stunts geared to before the 2020 election...they s are still pissed that he won in 2016...theyll never get over it. AHAHAHAHAHAHAHHAHAHAHAHA....

I think his lawyers made the wrong argument. They should have used the argument that turning over tax returns is not a constitutional requirement to be president.
