DOJ Spox Kerri Kupec: DOJ Will Weigh in AGAIN on Flynn Case

Kerri Kupec: So the DC Circuit has invited the Department of Justice to weigh in and we will do so. We will reiterate the arguments we made in our brief — which we believe this case should be dropped. Certainly as the prosecutors in this case as the Department of Justice we have the prosecutorial discretion to make that decision. And Sean, Jeff Jensen, he’s the US Attorney who the AG appointed to review the Flynn case, ten years a career prosecutor also spent ten years in the FBI. When he [Jeff Jensen] completed his review of the Flynn case, he told the Attorney General that based on what we now know he does not believe that any one of our 93 US Attorneys in the country would have continued to prosecute this case.

So this is a Barr trap. Any of the 93 US attorneys who claims he would prosecute will have to put his job on the line, and after a fair opportunity to explain why, can be fired.

So the members of the FraudCo/Sullivan cabal are now asking if DOJ is really, REALLY sure they want to drop the case?

Sounds like a veiled threat to me.

It's a huge trap. When you make a claim about your belief that 93 wouldn't do x, you can count on the Deepsters searching hard to find dirt on one of the 93 to force him to state he would.

And no experienced person would make a claim like that unless it were true, or else that the counterclaim would blow up in the counterclaimant's face.

Give it a break. First, Jensen's statement is not going to be in the brief to the court. His opinion or belief is irrelevant. DOJ makes the decision not to prosecute, not the judge or Jensen. The decision has been made.

Did you read the initial 20 page DOJ statement to Sullivan justifying why they will no longer prosecute? Since then, more exculpatory material not given to the defense has come to light. The new DOJ input will cite this new information further strengthening the justification for their decision.

Not really needed because the law requires the judge to dismiss the case. It's over and has been for some time.

Does that matter? No one is asking for volunteers. This is up to the AG. It goes forward if HE wants it to go forward. And he doesn’t.

I don’t see anything like a trap.

Seriously, any prosecutor who would NOT file a motion as the Justice Department has just done in the Flynn case is unethical and, in my opinion, should be fired from their position. Any prosecutor who actually did what the Muller team prosecutors did should not only be disbarred, but should go to jail, just like what happened to Mike Nifong, only longer because the conduct was even more egregious.

Talk about missing a point. It's a trap for any of the 93 US Attorneys who might think they should up and provide Wilkenson a statement suggesting that they would go forward. And believe me, the deepstate is searching desperately to find one.

Clearly and without a doubt Michael Flynn is the Rosetta Stone of the entire Russia hoax conspiracy and attempted coup which Obama was the figurehead and the master behind it

It was Obama’s clear hatred of Flynn because of his disagreement with his policy for his homey’s in Iran which sparked all of this

Flynn should be a freeman already but they still have a gag order on him and are trying to come up with some way to convict him of something so he can’t talk

this is going to be a losing effort

it already is Flynn is already a hero to millions and millions in this country and

this is not gonna and well for the Democrats

I am just curious.

Who “fires” Federal Circuit Court judges?

I’m thinking those judges who are Presidential Appointees are on the bench for life unless they are removed by Congressional Impeachment (Alysee Hastings). In which case as long as the Dem’s control the House Sullivan is safe from any oversight.

But honestly I can’t say that for sure.

I agree but what the hell has Sullivan been up to?

Unless some one has pictures of the judge with a ________ then Sullivan must be F'n nutz.

I'm not sure why but no sane person, with the experience that Sullivan has would take this unwinnable position.

It should be over with Sullivan having dismissed it, but I expect it to end up going forward. Sullivan isn’t stupid, he has to have a maneuver planned out by the deep state to keep this alive. I’ll bet the DC circuit wimps out and sends it back to him for further consideration. I still say when it’s over he will give Flynn about 3 years sentence.

So what happens if they find one? It is totally irrelevant.The case is dismissed by either Sullivan or another judge. They have no choice. DOJ is not going to prosecute the case. The AG has decided.
