Over the last few months, Virginia Democrats have worked to pass extreme gun control measures in the state. In fact, a Democratic congressmen went as far as to say that the National Guard my have to be used in order to enforce a door-to-door gun grab.
And ultimately, Im not the governor, but the governor may have to nationalize the National Guard to enforce the law, Rep. Donald McEachin said, according to Newsweek. Thats his call, because I dont know how serious these counties are and how severe the violations of law will be. But thats obviously an option he has.
However, one National Guardsman who opted to remain anonymous will not be going along with states prospective gun control measures, writing a direct letter to McEachin that we will not comply.
Heres the letter, per Law Enforcement Today:
Mr. McEachin, have you ever heard of a little thing called the Posse Comitatus Act of 1878? Apparently, you are not.
Allow me to fill you in.
The purpose of the act is to limit the military branches from enforcing laws against US. citizens. While the PCA does not prevent a governor from calling the Virginia National Guard, the law enforcement capacity of the Guard while on state active duty is full-scale enforcement of martial law when local law enforcement can no longer maintain civilian control.
Are you listening Mr. McEachin? If Governor Northam were to call up the National Guard, it would be through enacting martial law.
Martial law is the imposition of direct military control of normal civilian functions by a government, especially in response to a temporary emergency such as invasion or major disaster, or in an occupied territory.
Sheriffs and police chiefs refusing to go against the Constitution to fulfill your stupid anti-gun drivel hardly constitutes a temporary emergency.
If you and your fellow Constitution-hating hacks continue to push an agenda of gun banning, forfeiture and confiscation, I can almost assure you that you might meet more than one requirement for enacting martial law.
If you force local law enforcement to start violating peoples 2nd Amendment rights by taking their guns, you will wind up with temporary emergency due to an occupied territory.
If the state deems that it should enact martial law because sheriffs, whose only crime is standing up for the Constitution, here is what it looks like.
The state Constitution would be suspended. So would habeas corpus and civil rights.
There would be no freedom of the press, assembly or speech.
Curfews would be enforced on the people.
Troops would be in the streets for enforcement.
Checkpoints would be set up for control.
The Guard would have the ability to hold a person without charge.
Imprisonment without representation or due process.
Seeing that we are talking about gun control, there would be warrantless, house to house confiscation of firearms, ammunition, food supplies.
I have to wonder if this is really what Democratic leaders in Virginia want. Because what it equates to is a tyrannical government using its military as enforcers.
And that is exactly what the 2nd Amendment was created to protect against.
If the Virginia legislators want to push this issue, it could get ugly.
And oh, by the way, plan on seeing the vast majority of the Virginia National Guard become Conscientious Objectors. It will be really hard for them to arrest cops and confiscate guns when none of them will carry the necessary arms to enforce said arrests and confiscations.
How do I know this? I am one of them and will be one of the first to lay down my gun and walk away.
I will not be a pawn in a tyrannical game of human chess. Neither will most of the men and women I serve with.
Let us know what you think of this National Guardsmans letter to Rep. Donald McEachin about not complying with anti-2A gun control measures.
Mayors can be recalled.
This would not even be an issue if over half of the states Republican voters had not chosen to stay home on election day. Elections have consequences.
We impeached him; why take it to the Senate?
Just imagine if Hillary had won.
We continue to see example after example of how narrowly we averted tyranny.
“I encourage everyone to look back at Boston after the marathon bombing and the unlawful house to house searches by jackbooted thugs.”
That was scary, but a whole different scenario.
“Even with our superior # of guns the Gubmint has the advantage.”
Not with hundreds of thousands of people from PA, MD, WVa, TN etc, pouring-in to support you.
Rep. Donald McEachin is black and his heritage is such that he never learned Virginia History. From before the beginning, Virginians formed volunteer militias to defend their lives and property. The Bill Of Rights was appended with the knowledge thse Militias were fundamental to being American
Then along comes a black man with no cultural knowledge of Virginia history seeking to destroy that which the brilliant white Virginians created. Americans, real americans will not tolerate the Africanization creep
Where are “our” injunction happy judges??????
Thanks! That article, unintentionally I suspect, explained a lot. So does the census data for NN, which I just took a quick look at. Sigh.
So true, several hundred thousand “Republican” voters stayed home in KY and LA gubernatorial contests this year. They are none to faithful.
The classic definition of when martial law can be enforced is this: is the situation so desperate that the courts cannot be in session. Rather doubtful this condition would prevail.
“What can the governor be thinking?”
I am the governor. They will do as I command.
From your lips to Gods ears.........
This map looks like a national election map that is mostly red except for the demon rat holdouts in large metro areas. My wife is from Dickenson County in the far south west by Kentucky. We will be traveling there in a few months for an annual reunion. I typically travel armed, and wondering just what it will be like by that time, if travel would be safe.
A nice retort to their hypocritical terrorist illegals sanctuary cities. Next up, articles of impeachment on their intimidation and manipulation of elections violating “democracy”...
My oath was to the US Constitution and for what it stands for, not for some Governor...I would have to resist any order to confiscate weapons because of a political hack’s desire to destroy the Constitution...
<><> Governor Ralph Northam, a pediatrician, actually endorsed infanticide......in his most soothing bedside manner voice, told how in third trimester abortions if a baby to be aborted survives its trip through the birth canal, the doctor and the mother can have a discussion about that babys fate, with the implication being that if mother and doctor decide that baby will not live, it will be dispatched in one form or another....IOW, infanticide.
<><> that interview did not end Governor Northams political career. Northam was able to weather revelations shortly after that interview that he appeared in his medical school yearbook depicting someone in blackface standing next to someone in Ku Klux Klan regalia. Northam did later confess to having worn blackface in the past, helpfully advising people not to use shoe polish to achieve the effect, since its so hard to remove).
<><> Va's Democratic lt governor, Justin Fairfax, stood credibly accused of having sexually assaulted two women, also without having to resign. Fairfax has just announced that he plans to seek the governorship.
<><> Not to be outdone, the third in line in Virginias state government, Democrat Attorney General Mark Herring, admitted himself to having work blackface. He also survived this scandal, which would unquestionably have finished the career of any Republican.
All of these Democrats continue in office to this day. And what is most concerning is that, notwithstanding these bombshell disclosures, the Old Dominion would see the Democrats take control of both the State Senate and House of Delegates six months later.
The Guard should surround the State House, lock them in, keep them with plenty of food, water & electronics and let the good Virginians go about their business.
The only problem is the people in the state house!!
And good luck trying to recall the expletives-deleted.
VA’s recall process is a cluster.
We will not comply. We don’t wanna die.
We’ll be there.
