EXCLUSIVE:Border Patrol Whistleblower Provides An Inside Look At America's Broken Immigration System

For years, Immigration and Customs Enforcement (ICE) and the Border Patrol have said their facilities are overwhelmed and the system is severely broken. Politicians in Washington, D.C. have debated the issue, but one thing they can't debate is the cold hard facts. And the fact is we have people from around the world taking advantage of loopholes in our immigration system, a Border Patrol whistleblower told Townhall.

Central American caravan riders have overwhelmed the Border Patrol since last fall when they began coming to the United States en masse. Mexico established a system to help the U.S. deal with the people who were coming to America, allegedly seeking asylum. Those who wanted to seek asylum had to go through a port of entry, file the paperwork and then go back to Mexico to wait until their court date. Mexico even offered to provide humanitarian visas to those who couldn't legally enter into the United States so they could stay in Mexico and work. But that's not what these migrants wanted. They want a life in America.

People from other countries – especially those labeled "exotics" by Border Patrol – have figured out a way to skirt the new system: cross the border, find an agent and say, "I want to see an immigration judge." Border Patrol processes them and out the door they go, released into America. Of course, they're given a court date but the immigration court is so backlogged that their date isn't for two to three years down the road and the reality is, once they're released, they don't show up for their court hearing. What incentive do they have?

Things continue to heat up along the Southern border. Democrats have said we don't have a crisis at the border, but statistics and figures say otherwise. U.S. Customs and Border Protection's Acting Commissioner John P. Sanders said last week that Border Patrol is having to transport "hundreds of families by bus and aircraft from the U.S. Border Patrol’s severely overcrowded processing facilities to less-crowded stations along the Southwest border."

Smaller stations, primarily quick processing centers designed to target drug traffickers and cartels, have had to take on this additional responsibility. Illegal aliens were flown from Texas to San Diego and bused to various facilities in the San Diego sector, despite the sector designed for short-term holding (24 hours).

Despite being designed for short-term holding, illegal aliens are being held for long periods of time, documents provided to Townhall reveal. As of May 19th, the Brown Field station had 100 detainees who had been held for seven days and another 91 who had been held for six days. The Murrieta station had 16 detainees who had been held for eight days and Imperial Beach had seven that had been held for 30 days. The Chula Vista station had 223 people in custody in 10 cells, five of which exceeded maximum capacity, documents provided to Townhall show. And all of these facilities are designed to hold people for a maximum time period of 24 hours.

The reason this is a big deal: these short-term facilities lack basic necessities and amenities. The Murrieta station, for example, can hold a maximum of 25 people. There are no beds, no showers, one or two toilets and simple metal benches. They are literal jail cells that people are being shoved into like cattle. And when this happens, it's not only inhumane but it's also unfair to Border Patrol agents. Despite being "pre-screened" for health conditions, guess what's happening? Communicable diseases are popping up. San Diego recently had a flu epidemic that was directly traced back to the aliens who were flown from Texas for processing. Agents are doing what they can to identify health issues but they're not doctors. They're not trained to spot measles, TB, the flu and other diseases, the whistleblower revealed.

And here's where things get even more twisted. If an illegal alien comes up sick, agents are forced to take him or her to a nearby urgent care or hospital for treatment, exposing everyone in the community to the communicable disease. Border Patrol and ICE aren't required to report said diseases to the Center for Disease Control so there's absolutely no way for the CDC to accurately track where an outbreak began, the whistleblower explained. Not only that, but agents are getting sick themselves and they're bringing these diseases home. They're exposing their kids and family members to the diseases they're being exposed to while on the job.

The whistleblower who spoke to me explained the general concern amongst agents tends to be the same: agents really aren't on the border right now because they're spending basically all of their time and resources processing people who ask to see immigration judges. The illegal aliens figured out our "catch and release" system so they're coming in droves. Not having anyone along the border means we essentially have open borders. The drug cartels and terrorists are taking advantage of that fact. Agents are seeing more "exotics" – people from South Africa, Somalia, India and the Middle East – than they otherwise would have. It's not just those from Central America, like Guatemala and Honduras.

Between May 12 and May 18th, the Chula Vista station alone had people from the following countries, according to documents viewed by Townhall:
• Honduras - 69
• Guatemala – 51
• India - 43
• El Salvador - 23
• Nepal - 3
• Ecuador - 3
• Brazil - 2
• Senegal - 2

These aren't people coming to the port of entry and asking for asylum either. They're illegally crossing, waiting to be apprehended and told they want to see an immigration judge. They get processed and then are being released back into the community.

In Southern California, the Department of Homeland Security is dumping these illegals at various locations, from bus stops to malls. They essentially throw them in our communities and say "see you later," even though it's really "we'll never see you again."

The only time an illegal is kept in custody is if he or she has been convicted of a crime in America. Theoretically, someone could have committed murder in Honduras, but unless that conviction was reported to the international database, there's no way for agents to know that the person has a criminal background. We're literally letting anyone and everyone into our country, the whistleblower said.

President Trump is correct: there is a crisis at our border. Sadly though, his hands are tied until Congress decides to take action. The first step is to close our border and build the wall. The second step is to remove the requirement that every person sees an immigration judge. These illegal aliens are using our system against us. They don't have a Constitutional right to due process because they're not American citizens. It's time to close the border and the loopholes.

Here is what is going on in Murietta, ca. they stood up to the feds and told them they would not accept illegals under any conditions. It worked.They stood up for 24/7 in 100 degree heat for days and beat the feds. Now the feds are trying it again.

Back in 2014, the Department of Homeland Security took illegal aliens captured in Texas, flew them to California and eventually bussed them to the small yet conservative town of Murrieta, about 70 miles north of San Diego. When residents in Murrieta and the surrounding community received word of what was taking place, patriots gathered outside of the Border Patrol Station to protest the release of illegal aliens into the community. They successfully turned a DHS bus around and kept it from entering the BPS facility.

For over a month, patriots camped out overnight and took shifts watching the station to make sure DHS was unable to dump the aliens at the station when residents least expected it. DHS tried to drop the aliens off three different times before giving up. They eventually canceled their fourth scheduled drop off.

The issue was brought about by Ron Zermeno, a Border Patrol whistleblower and member of National Border Patrol Council Local 1613, who spoke about the issues facing the Murrieta station, despite having a gag order placed against him.

The number one issue agents had with the illegals being dumped at their station: it's not designed for long-term holding. The Murrieta BPS was put in place primarily to catch drug offenders, meaning they're short-term holding facilities. There are no showers. There are no bathrooms. There are no beds. And there is no kitchen. It's a bare basic facility.

Here's the thing.

I was one of those people who sat out in 100+ degree heat. I saw a community come together to demand that our border patrol agents be treated with dignity and respect. They were being exposed to diseases, like scabies, despite being told the aliens they were dealing with were “pre-screened” for health conditions. Zermeno pointed out that agents weren't trained to identify or deal with infectious diseases but they were forced to deal with the situation as best as they could. Agents were told to wear long sleeves and gloves, as if that was sufficient enough to prevent exposure.

I saw a community stand up to the federal government and say “No, we don't want this,” despite living in a state that welcomes illegal aliens with open arms.

I saw a community who felt strongly about protecting young women and children.

The illegal aliens who were dumped in Murrieta were being treated inhumanely, something that pro-open borders people fail to realize. These aliens were being dropped off at a station that was designed to process drug offenders, not house people for long periods of time. They weren't living in sanitary conditions. They were literally in a government-owned building. That's it.

And now, it looks like DHS is trying their hand at it again. Illegal aliens were, once again, flown into California so they could be bussed into the Murrieta community. Instead of dumping them off at the border patrol station in Murrieta, DHS plans to drop them off at various locations, like motels and bus stops, throughout the Inland Empire.

Trump has tried as hard as he can but now its time for us to get the job done. Just like they did in Murietta.If any town or city accepts these illeagals the feds will keep on dumping them there. The challenge is not to accept them.

..............That means those of us that do not support this better stand up and speak out. We better not vote for anyone that supports open borders, illegal immigration for anything...not even local dog catcher.

Trump cannot fix this alone. If it can be fixed at this point we will have to support him.

Once again right there.Trump is not facing normal immigration problems. This is a Soros/cabal hit on him and the country aided and abetted by the dems who want the vote forever,the deep state, rinos and everyone else who hates the country.

This level of resistance is unheard of, that is the problem. It is easy to say well they are against Trump. The truth is the dims and RINOs are against conservatives. He is just representing us, the resistance is because he is fighting back. Make no mistake, it is us they are resisting. We are in the way of their agenda. They are willing to stop at nothing to get their way.

Well, specifically on the border issue, Trump could always try 8 U.S.C. §1182(f):

“Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”

Or, on the DACA issue, Trump could write this two sentence Executive Order:

“According to the exact language in the Immigration and Nationality Act, the DACA kids are unlawfully present in the USA. Therefore, I order the Secretary of Homeland Security to remove them”

An Executive Order like that could not even be reviewed by a federal court.

Or, Trump could write an Executive Order implementing Universal E-Verify. The statutes that support Universal E-Verify were passed in the Reagan Amnesty of 1986. Since then, there have been multiple agency regulations written for Universal E-Verify, and one successful Supreme Court case for Universal E-Verify.

Problem is, Trump is an immigration scam artist.

He does not want to stop massive immigration, he does not want to deport the DACA kids unless they are violent criminals, and he does not want Universal E-Verify.

Instead, he essentially begs the Democrat Party to seek nation wide injunctions, and when they do, Trump sends pro-immigration, Deep State, career DOJ lawyers into court to “defend” his case.

Bottom Line - on every significant immigration metric (except UN Refugees), Trump's numbers are within plus or minus 10% of Obama’s numbers.

By the way, before I read down to this post, I answered an earlier comment with the 8 USC statute you quoted.

I discovered that statute on the “Powerline” website (three Conservative Minneapolis lawyers) about 18 months ago, and I use it all the time.

Libertarian BS is easily measurable, too, it's just long enough to bump into something said "libertarian" doesn't like happens then it's time to enforce whatever laws said "libertarian" wants enforced.

Go blow snot on Pelosi a while, she's in charge of the House where they make law, when you're done there, blow snot on the Senate where they're not impeaching the Federal judges holding things up and replacing them.

When you're done with all that maybe someone will believe your NeverTrump BS is actually based on his performance rather than your personal animus.

I think it pays to remember that no one has ever gone after a potus like the hard left, cabal,rinos deep staters and now a few “supposed conservatives” are going after Trump. Never in history has this happened.To get what he has gotten done,energy taxes,tariffs(still WIP I know),etc. under these circumstances is to have achieved an excellent presidency so far. Your F grades carry little weight with me.

If you had to fight the fights President Trump has had to fight, you’d be in a mental institution drooling in your oatmeal (as would most of us)...yet he continues to fight and make progress over a broad spectrum as he puts ducks in a row to win the bigger fights....

We got the Patriot Act to more tightly control American’s finances and invade our privacy. Look at what you endure to open a bank account or get a drivers’ license - and now illegal aliens in parts of this country can get both.

My expectations have nothing to do with it; he is delivering little of what was promised, and much of it is outside of his control - so he needs to put the lawmakers of both parties on record to expose their positions openly.

Immigration was the biggest fight for which he was elected, and we’ve gotten close to nothing. The border is open, and thousands are still crossing EVERY DAY - with very few going back. Those children crossing will be quickly enrolled in public schools at our expense, and those “families” will be housed at our expense as well.

This isn’t some future doomsday scenario - it is happening RIGHT NOW, and has been happening FOR YEARS.

Good to hear from you, Eeyore.

The issue is the battle is much larger and on many more fronts than realized; pretty much the entire rest of the US government is against him.

A couple of examples:

FISA (you might've heard of that).

The continuing issuance of injunctions by Obama judges against Presidential Executive orders.

The State of New York weaponizing against the Trump administration, including passing an overtly, explicitly, verbatim unconstitutional bill-of-attainder to allow New York to release Trump's state tax returns to Congress.

The new revelations that the FBI was working hand-in-glove with the Italian government, to put some of Hillary's secure emails onto servers associated with a Trump ally / patsy, so they could force Trump to step down for espionage.

Tremendous amounts of corruption revolving around the Southern border (not just drugs, but child trafficking). Have you heard of the NXIVM case? Involving an heir to the Seagrams liquor fortune (where bail was set at $100 million in a Federal Court)?

Lots of tentacles there, including the former head of the US Secret Service offering to the be guardian of the group's ringleader during house arrest; the son of the President of Mexico being involved, and much more.

But that's not the kind of stuff Rachel Maddow covers, let alone Fox News or Rush.

Read up on the Arizona mafia -- Janet Napolitano's cronies, seeded throughout DHS.

There's a LOT more going on out of the mainstream eye, which has to be cleaned up before we can move against the principals.

That’s why Presidents have to twist arms, build coalitions and persuade people to support their agenda. The Presidency is not a one man show. It takes teams to win. Trump has failed to get people on board. Thus he can only do so much by himself.

Being president is rife with landmines Had he done what I posted earlier on Jan 21 2017 all of which was under his power we would have a million fewer illegals in country and the worst political criminals in USA history would be in prison. He has yet to earn my vote on those counts. But he can count on people like you that provide him scapegoats
