Freedom of association. You can also deny someone a job for drinking, and for smoking tobacco. You decide what your job requirements are. And in the world of moving heavy stuff where insurance premiums matter, those requirements often include peeing clean.

Companies master the wizardry of economics, then seek to repeal the very basics of supply and demand for THEMSELVES.

No American applicants at $10/hr to pick lettuce day..? Well, there’s no alternative to that, no..!

I mean, sure, surplus bread at the supermarket swiftly clears from the shelf when offered at half off, sure —like magic.

But NO WAY do we want to pay more than $10/hr to get those new applicants to appear at our door.

I mean, that would be doing something DIFFERENT. And we couldn’t do that. I mean....it would be DIFFERENT.

No matter the drugery or danger, behold the way the dusky, energetic applicants crowd our door. Even if they can’t speak English, yes.

Gosh, I wonder why.

Very easy. Marijuana is still illegal under federal law and federal law trumps state law. The feds just haven't cracked down on states that have "legalized" it.

The business of business is to make a profit, not to pay unprofitable wages

Yet their competitors pay the prevailing price for labor, raw materials, energy etc. It's called supply and demand. That the law apples to labor is lost on Capitalists.

When hamburger meat prices double over 10 years does McDonald's go out of business? HELL NO.

The problem is if this employee causes an accident or death while on the job, who are they going to sue?

Then we should mandate that any company that tests for Mood Altering Substances, Test for ALL Mood Altering Substances, especially Alcohol and Caffeine, maybe even chocolate too. ANd it should Apply to EVERYONE in the Company and the Shareholders.

The quick and dirty answer is that in many cases the drug-testing requirement comes from the Feds. State law is irrelevant.

Do you think our whacko-lefty House of Representatives will pass a bill overturning Federal prohibition of marijuana?

If passed, half of the voters will be outraged & the other half will be toking up out of joy.

It is intellectually dishonest to compare chocolate to illicit drugs.

You smoke pot, can’t pass a drug test, that’s your problem not mine. As an employer I will not hire pot users. Ain’t happening. If smokers want to use it, that action has consequences. No job with me.

Anyone who has worked in any business know working with those that are stoned are worthless and are no better than drunks,meth-heads or coke users. The liberal push for pot is for one reason only and that is pandering for votes and wedging the issue against Conservatives.

No smokers? I think that is correct. You don’t have to hire smokers, they are not a protected class. No, in some places you might not be able to fire an existing employee who is a smoker. Ah, but I live in a right-to-work state. No smokers before or after hiring. Period. Nor vapers.
