New York Supreme Court denies request to dismiss Trump Foundation lawsuit

New York's highest court has denied a request to dismiss the state attorney general's lawsuit against the Trump Foundation.

The New York Supreme Court, in documents made public Friday, denied a request from the defendants — President Trump, Ivanka Trump, Eric Trump and the Donald J. Trump Foundation — to dismiss the lawsuit alleging they used the foundation for private and political gain. New York Attorney General Barbara Underwood welcomed Justice Saliann Scarpulla's decision.

"As we detailed in our petition earlier this year, the Trump Foundation functioned as little more than a checkbook to serve Mr. Trump's business and political interests," Underwood said. "There are rules that govern private foundations — and we intend to enforce them, no matter who runs the foundation. We welcome Justice Scarpulla's decision, which allows our suit to move forward."

The lawsuit was filed in June. Underwood hopes to dissolve the foundation and seek $2.8 million in restitution. The suit claims the foundation illegally helped support Mr. Trump's campaign by raising money at a nationally televised fundraiser in January 2016 and then allowed campaign staffers to dictate how the funds were spent.

At the time the suite was filed, a spokesperson for the foundation called it "politics at its very worst," saying the foundation has donated more than $19 million to charitable causes, more than it ever received.

Last month in court, Scarpulla, the judge, appeared skeptical of the Trump legal team's claim of political bias.

"It's not something that's really of interest to me," he said, adding later, "I don't want to get involved with that."

"The allegations are what they are," the judge said at the time.

I find this awfully interesting - as Trump has had no need to use his foundation for “personal or private gain”...

Where is the similar lawsuit against Hillary and her Clinton Foundation? You know - the one where she and Bill are DOCUMENTED to have skimmed from it - having raised funds for Haiti yet didn’t use it there.... Oh - and the political payoffs laundered through the foundation (including from RUSSIA)...

I guess that is different?

The “New York Supreme Court” is not that state’s “highest court.” Instead, the “New York Supreme Court” is the trial court. New York’s highest court is the New York Court of Appeals.

The New York Supreme Court is a trial court. The highest court in New York is the New York Court of Appeals. The idiot at CBS who wrote this story ought to know that without having to ask.

I would believe Scarpulla represents the Supreme Court of New York in reviewing the motion to dismiss, as opposed to him being the Supreme Court.

I thought I remembered from my mid-50s civics classes that the NYS Supreme Court was NOT the highest court in the State judiciary.

Seems as if wiki agrees with me
The Court of Appeals, sitting in Albany and consisting of seven judges, is the state's highest court. The Appellate Division of the New York State Supreme Court is the principal intermediate appellate court. The New York State Supreme Court is the trial court of general jurisdiction in civil cases statewide and in criminal cases in New York City.

But hey, what do I know compared to the journalists at CBS

You express my feelings precisely.

I cannot understand why the RNC hasn’t taken some action to address all of the obvious fraud perpetrated in the midterms!!!

Just think how much better off we would all be if the GOP fought with just a fraction of the united front of the RATS!!!

The RNC must find new leadership yesterday if President Trump and his MAGA forces are to have any chance in 2020.
Ronna McDaniel’s vaunted ground game, etc., is no match for all of the RAT cheating!!!

I know. I am just in a state of frustration over the RNC’s refusal to look into fraud. How to get rid of the state Republican organizations? They must all be corrupt. Just go look at the Arizona Republican state organization website. The head of it appears to be a wilting squish.
