Judge in Flynn case recuses himself
The Hill ^

Posted on 12/07/2017 6:05:21 PM PST by TigerClaws

The judge who took a guilty plea from President Trump's former national security adviser Michael Flynn last week has recused himself ahead of a sentencing hearing.

A court spokeswoman confirmed to Politico and other outlets that the case was reassigned after Judge Rudolph Contreras, an appointee of former President Barack Obama, recused himself.

Judge Emmet Sullivan, an appointee of former President Bill Clinton, was randomly selected to take his place in the case.

The switch comes after Flynn pleaded guilty to lying to the FBI about his contacts with Russians in the month before Trump took office.

Flynn's guilty plea is the most dramatic development yet in special counsel Robert Mueller's probe into Trump campaign associates' ties to Russia.

Flynn has agreed to cooperate in the investigation led by Mueller, who has also secured indictments against three other former Trump campaign associates, including former Trump campaign chairman Paul Manafort.

There are now public reports that Mueller and company hid exculpatory evidence from Flynn prior to the plea

It's worth noting that the DOJ IG, Michael E. Horowitz, going all the way back to August, must have know about the exculpatory evidence. And he too didn't stop the Flynn prosecution.

I agree but there is scuttlebutt around that Flynn may have made a deal to spare his son from some legal jeopardy. In that case, he may not want to withdraw the plea unless he is sure his son is safe. I hope that isn’t the case but I wouldn’t put it past some of those Democrat-leaning prosecutors.

Why did the Judge exit?

Flynn filing this motion could get half a dozen lawyers disbarred. Including Mueller.

A judge could ask toss out the entire case.

Wouldn't that be a great comeuppance?

Flynn stands up and admits a process crime, then foul play by the special counsel's office brings him divine intervention.

Remember the Duke rape case?

Prosecutor disbarred for not disclosing evidence that would have been helpful to defendant. Oops!

This should be big news. I haven't seen the networks cover it yet. Contreras chided Flynn at his initial hearing when he pleaded guilty that Flynn must cooperate with Mueller or else. I wonder if the Mueller team was in contact with the judge prior to Flynn guilty plea/

Reuters, Politico, the Washington Examiner have the story but no one knows why the judge recused himself. The fruit of a poisonous tree?

If Flynn does one day in jail there should be rioting in the streets. I am sick and tired of these shenanigans destroying good people’s lives while real criminals like the Clintons and Holder and Obama and Lynch walk free living the good life. At our expense!

Sorry, I don’t understand your question. I might be dense here. The discussion centered around the judge recusing himself ahead of the sentencing hearing and a commentator asked why the judge would preside over a trial and then recuse himself from the sentencing hearing. I replied there was no trial because Flynn pleaded guilty. The rest of the discussion deal with whether Flynn can or will withdraw his plea. So since the sentencing hearing hasn’t happened yet, what is your concern?

Jail for judges who legislate from the bench and offer unlawful justice.

There are now public reports that Mueller and company hid exculpatory evidence from Flynn prior to the plea. This obligates the Judge to report Mueller and company for possible bar violation or even illegal conduct.

If so... DISBARMENT!

If the Gateway Pundit information is correct, General Flynn has an available legal remedy.

If Muellhead were an honorable man he would drop the charge. He knew the FBI agent he used in his investigation was a lapdog for HRC and anti-Trumper and yet he used him to question Flynn which set up the charge. Then he hid this information from the oversight committee and would not allow him to testify until he got his plea agreement in.

How old is the Judge that recused?

Obama appointee. Young. Career ahead.

Let the old guy take the bullet and then retire. Give him the career killer case.

That’s my guess. I haven’t looked up bio info yet.

WHOAH!

Now that he knows that the gig is up ... it's like in The Untouchables when the prosecutor tells the Judge that his name is among the names of those paid off by Capon and he switches the juries.

I continue to believe, either Mueller is indeed a pathetic deep state hack whose whole case now lies like a dead stinking carcass ... or he's the greatest lawman since Elliot Ness and this has been the greatest sting in the history of the earth!

Still TBD and this doesn't enlighten as to which ... but ... wow! And the salacious nature of the FBI couple is now known to many the MSM thinks they've kept these facts from.

I can’t see what reason he’d have to recuse from the sentencing that wouldn’t also require he recuse from the trial.

There was no trial - LTG Flynn pled guilty.
