Will Obama Unleash A Regulatory Tsunami On His Way Out?

Economy: When running for office, Donald Trump promised to reduce the regulatory burden on the economy. But before he gets a chance to do so, President Obama will likely add to those burdens with a last-minute regulatory rush.

In a memo to her staff, EPA Administrator Gina McCarthy said that "we're running — not walking — through the finish line of President Obama's presidency."

The memo is indicative of what's come to be called "midnight regulations." These are rules an administration rushes out the door just before leaving. The number of rules increased in President Clinton's last year, and in President Bush's.

But given that Obama has been an aggressive regulator to begin with...

...Through the first 10 months of this year, Obama regulators have approved 122 "economically significant" regulations, according to a report from the American Action Forum. "Economically significant" is a polite way of saying that these rules will cost a lot of money to comply with...

...Earlier this year, House Republicans produced a detailed plan to rein in the regulatory state through a variety of reforms, such as sunset requirements, a "regulatory accountability act" that would require a better accounting of a regulation's economic impact, and others.

The bottom line is that if Trump and the GOP really want to make inroads on regulatory costs, they will have to be far more aggressive about getting rid of costly rules than regulators have been in putting them in place.

There is no reason these rushed regulation changes cannot be revoked by President Trump. They are not law in the sense of legislated law. They are manner and practice instructions for Executive Agency Departments to follow and very likely won’t even be Executive Orders. Maybe Executive Memoranda.

THIS DOES NOT MAKE THEM LAW. As such he can instruct the EPA for example to rescind the changes until such time their validity and applicability to some legislated law they should be operating under is conclusively proven. Or, he can just rescind them by Executive ORDER and be done with it.

The only thing Trump CAN’T undo do is the pardons Obama will probably be handing out to these EPA Nazis on his leaving

It is a zillion dollar question. However, Obama is already on notice that all of this EOs will be undone during Mr. T’s first days in office.

And just how many of those regulations are a direct result of EO’s one might ask?

Trump is already on record many times saying a major platform is to cut as many of these regulations as possible so with respect to Cornyn whining about a signature, get with it right now so they can be ready for a signature on January 21st. These establishment goons keep looking for ways to fail us while never finding a reason to not benefit their donors and pockets.

Simple solution: Gut the agencies who are promulgating these regulations, and have the GSA sell off the buildings they currently occupy so they are unable to restaff if the RATS ever get control again. As one poster said recently, “The EPA should not have the ability to regulate a mouse fart come January 21st!”

I hope he does. It will cause Obama to be even more unpopular, and Trump will encounter even less resistance as he frees the American people from their socialist/regulatory shackles.

It doesn't work that way. The upcoming Lame Duck session will be the last act of the 114th Congress. What they leave unsettled, without a presidential signature, automatically dies when the 115th Congress is seated on January 3. Thus, anything that might be passed by the 114th won't be available for Trump to sign when he takes office.

Not a problem. Just revoke those regulations as soon as the new EPA Administrator is confirmed. Then eliminate the EPA.

Yep :) obummer will be erased from our memories as soon as Trump takes office and undoes all the damage.

At least I’ll never give him another thought except when he’s being praised in the news for God knows what.

Cornyn is referring to Executive Branch regulations that come directly from Federal laws in which the Executive Branch is empowered to impose them.

On the first day of the Trump administration, Congress can start by passing a law that prohibits any regulation imposed under this statutory authority to terminate within five years. Force Congress to re-authorize the Executive Branch every five years for every regulation that is imposed -- through separate acts of Congress.

The Constitution mandates that Congress convene at noon on January 3, unless the preceding Congress by law designated a different day.

That gives them from now to then to get it ready for passage to be voted on between January 3 and 21.

This whole regulatory process needs to be redone, or better yet, done away with. Folks like the EPA are creating rules with penalties as though their rules are legislated law.

Legislation, such as the Clean Water Act, needs to be rewritten so that any rules derived from the act are specifically spelled out in the act.

They increased just before Bush got out? Of course. He was one of the biggest RINO lefties of modern times. Why not? This jack ass is my biggest presidential disappointment, actually worse than obama, ‘cause he was supposed to be on our side.

May the Clinton and Bush families rot in Hell!!!

Of course he will and will make it as difficult as possible to get them revoked. The Obama functionaries are rushing through the regulatory process and the incoming Administration will often have to go through the same rule making process to revoke them; lawsuits will be filed and liberal judges will try and stop Trump from reversing course. The whole plan is to try and further cripple the US and make the first year a pitched legal battle.

I do not recall Bush issuing lots (any?) of regulations on his way out. We were losing both houses of congress. What I do remember is Republican members of congress just going home after the 2008 election. I and many other Freepers called many members of congress to see what they were doing to pass laws before their lame duck session ended. Dems would have worked around the clock to do as much as they could Our side just went home. Another outrage by weak Republicans. That was before I realized how strong the uniparty is.

Thankfully we now have Trump. Without Obama we would have a Dem or a uniparty Rino. There is real hope for our country.
