Trump Camp: Ted Cruz Is ‘The Reason Why Obamatrade’ Passed

The reason why Obamatrade became law is because of Sen. Ted Cruz,” said Donald Trump’s senior policy advisor Stephen Miller on Monday’s program of Breitbart News Daily.

Miller — who had been working for Sen. Jeff Sessions at the time that Sessions led the conservative opposition to Obamatrade in the U.S. Senate— said that Cruz’s “lobbying” effort to fast track President Obama’s Trans-Pacific Partnership “was the difference maker” that enabled fast track to pass.

Like Sen. Cruz, Obama had been pushing for fast track to ensure the passage of TPP. Fast track lowers the 67 votes required to pass a treaty to a mere simple majority, it surrenders the 60 vote filibuster, and it forfeits individual senators’ ability to add amendments or changes to the trade deals negotiated by the president. As Sen. Sessions explained, “A vote for fast-track is a vote to authorize the President to ink the secret [TPP] deal contained in these pages—to affix his name on the Union and to therefore enter the United States into it.”

TPP apparently has not been "fast tracked". The next president either Cruz or Trump will renegotiate it and the new TPP will be fast tracked and voted on at that point.

Why is it so hard to understand TPA and TPP are related but separate issues and that so called "fast tracking" of trade agreements (TPA) and treaties is normal? If this wasn't done it would be virtually impossible to gain approval of any such agreements. If what I've read about TPP is correct it should and will be voted down by a combination of Conservative anti-globalization and pro-labor Liberal members.

If Congress allowed its members to propose amendments to initialed agreements the entire negotiation process would have to begin over again. That essentially takes the constitutional authority of negotiating a treaty out of the president's hands and into Congress'. That may be appealing with Obama in the White House but sets a bad precedent for the future. Equating passage of TPA with passage of the agreement itself is misleading. Some people doing it out of ignorance. Others know the difference but just want to use confusion on the subject as a hammer against certain candidates.

As of 2013, the majority of United States free trade agreements were implemented as congressional-executive agreements.[63] Unlike treaties, such agreements require a majority of the House and Senate to pass. Under trade promotion authority (TPA) , established by the Trade Act of 1974, Congress authorizes the President to negotiate "free trade agreements … if they are approved by both houses in a bill enacted into public law and other statutory conditions are met." In early 2012, the Obama administration indicated that a requirement for the conclusion of TPP negotiations was the renewal of TPA. This required the United States Congress to introduce and vote on an administration-authored bill for implementing the TPP with minimal debate and no amendments, with the entire process taking no more than 90 days.

In December 2013, 151 House Democrats signed a letter written by Rosa DeLauro (D-CT) and George Miller (D-CA), which opposed the fast track trade promotion authority for the TPP. Several House Republicans opposed the measure on the grounds that it empowered the executive branch. In January 2014, House Democrats refused to put forward a co-sponsor for the legislation, hampering the bill's prospects for passage.

On 16 April 2015, several U.S. Senators introduced "The Bipartisan Congressional Trade Priorities and Accountability Act of 2015", which is commonly known as TPA Fast-track legislation. The bill passed the Senate on 21 May 2015, by a vote of 62 to 38, with 31 Democrats, five Republicans and both Independents opposing. The bill went to the U.S. House of Representatives, which narrowly passed the bill 218-208, and also removed the Trade Adjustment Assistance portions of the Senate bill. The <(NEW) TPA was passed by the Senate on 24 June 2015, without the TAA provisions, requiring only the signature of the President before becoming law. President Obama expressed a desire to sign the TPA and TAA together, and did sign both into law on 29 June, as the TAA was able to make its way through Congress in a separate bill. The ultimate approval of this legislation conferred on the Obama administration "enhanced power to negotiate major trade agreements with Asia and Europe."

Through the (new)TPA, Obama could "submit trade deals to Congress for an expedited vote without amendments." The successful conclusion of these bilateral talks was necessary before the other ten TPP members could complete the trade deal.

The terms of the TPA stipulate that when a deal is formally submitted to Congress, they must act within 90 legislative days. According to Politico, many expect Congress to vote on the bill either during the Summer of 2016 or in the lame-duck session after the 2016 elections.
