The Constitution Does Not Require the Senate to Vote on a Nomination

Senator Schumer appeared Sunday on ABC's This Week and responded to suggestions that the Senate might not confirm the lame-duck President's nomination to replace the late Justice Scalia: "show me the clause [in the Constitution] that says [the] president's only president for three years."

True, Presidents serve four-year terms. But here's a question for Senator Schumer: Can you show me the clause that says the Senate must vote on, let alone confirm, a President's nominee?

I'll save him the effort: There is no such clause in the Constitution

Our Republic is in severe jeopardy today because of Justice Scalia's death yesterday.

I'd like to think the Senate would stand strong, but I believe Obama will appoint Scalia's successor, and that McConnell and the Senate will confirm anyone Obama wants, including the odious Eric Holder.

Imagine a 5-4 Supreme Court decision interpreting the 2nd Amendment to ban the mere possession of handguns and semi-automatic rifles. It could happen, so quickly it would make our heads spin. MILLIONS of us would not comply, of course. Any attempt to force us would lead to mass death.

But this one event, Scalia's death, could be the inflection point of the downfall of the American Republic, and quite possibly the traceable initiation of the 2nd American Civil War.

Instead of February 2016, it’s February 2008.
Instead of Scalia dying, Ginsburg dies.
Instead of Ogabe, Bush is President.

DOES ANYONE SERIOUSLY THINK HARRY REID WOULD HAVE EVER LET A VOTE HAPPEN ON A NOMINEE PUT FORWARD BY BUSH???

There must be absolutely no caving on this whatsoever. No hearings, no vote, nothing.

I will never understand why 9 unelected people with very little, if any experience, in the real world have almost God-like say so about anything and everything. The USA would work with an informed, educated and rational citizenry. Sadly the current population does not even remotely approach any of these criteria. Hey, did you hear Kim Kardashian is gonna be on ‘Dancing with the American Idols’ or Boston might make the wild card in the playoffs ?

imho; obozo will put a commie justice on the court and based on the past 7 years, there is NO ONE in DC willing to step up and stop him. DC politicians words are not only cheap, they are mostly lies! An anti-Constitutional Supreme court will be all obozo needs to drive the final stake in the heart of this country. And where will the US military leaders be when they are needed so desperately? Looking out for their own asses as they always have and will fail to do their sworn duty. As the last hold out at the Oregon Wildlife Reserve HQ was told by the federal agents; "We are just doing our job". Obviously their oaths mean nothing either. The hold out said to the federal agents as they took him away (paraphrasing); this is your country too and you are being paid with blood money.

2016 looks like its going to be one hell of a ride.
