Ted Cruz Destroys Donald Trump On The Birther Question At Fox Business GOP Debate

Ted Cruz and Donald Trump threw down over the birther question. Cruz was ready for Trump and blew him up by pointing out that by his own standard, Donald Trump wouldn’t be eligible to run for president because his mother was born in Scotland.

Cruz got a question about Trump’s birther claims. Sen. Cruz pointed out that Trump said his lawyers examined Cruz’s citizenship, and it is a non-issue. Cruz delivered the line of the night, “Since September, the Constitution hasn’t changed, but the poll numbers have.” Cruz said that the birther theories that Trump has been relying on require two parents to be born on US soil, which means that Trump would be disqualified because his mother was born in Scotland.

Trump responded by saying that he is leading in the last three polls in Iowa, and the Cruz is going down. Trump cited Lawrence Tribe and other constitutional attornies who say Cruz can’t run. Trump said that he already knows that the Democrats will be filing a lawsuit about Cruz’s citizenship. Trump said, “There is a big overhang. A big question mark on your head. You can’t do that to the party.” Trump said that you had to have certainty.

Cruz responded that he has defended the Constitution in the Supreme Court and that this lawsuit has zero chance of succeeding. Cruz said that Trump is parroting attack lines from Hillary Clinton.

Sen. Cruz has proven to be the only other Republican candidate to toe to toe with Trump.

The Republican establishment should be very afraid because the only person that stand up to Trump on the GOP side is Ted Cruz.

Cruz last night said two things about this that I have a problem with.

1. Cruz said that the common law definition requires both parents to be natural born, and then used that flawed common law definition to disqualify most of his competitors including Trump. The fact is (and he should know this as a constitutional scholar) that the parents need only to be citizens (naturalized or natural born)

2. Cruz also cited a supreme court ruling that defined natural born to be the default status if you are a citizen that is not naturalized. I’m not sure what ruling he was referring to, but even if it was an accurate reference, it would be a perfect example of how our constitution has been undermined by even the Supreme Court.

How can a status (Natural Born) with much higher restrictions and qualifications be considered the default over a less restrictive status (Naturalized)????

I'm a Cruz guy, but that is a non-sequitur. The standards of 1787 did not care where the mother was from. Only the Father mattered in determining citizenship.

The legal standard of the time was "Partus Sequitur Patrem."

Trump supporters are completely deaf on the issue and the ones on my Twitter feed are still convinced by Donald that
his point is valid.

Do you believe a man who admittedly spent a career bribing Democrats to build his business or the guy who spent 10 years fighting cases at the Supreme Court level? hmmmmmmm.....What to do, what to do....

Drudge has Donald at 51.5%, how can anyone claim he didn’t win? Or that Cruz cut inot his lead?

Almost as dumb as those who claim that lower fuel prices hurt the economy.

Yeah, Ted Cruz "destroyed" Donald Trump on the birther question - but Ted won't destroy the Media DeathStar.

They'll destroy HIM.

That's their opening. That's all they need.

And it isn't Trump's doing.

Cruz destroys trump on birther question?

NoMary Anne MacLeod Trump was born on the Scottish island of Lewis in 1912. On a visit to New York, she met Trump’s father Fred, and the two were married in 1936. Trump’s mother was naturalized in 1942.

Trumps mom was a US citizen at the timeeting of trumps birth

Two US citizen parents and born on US soil.
Trump is a natural born citizen

Trump was born in the USA, Cruz was born in Canada. Trump's mother's country of origin is totally irrelevant, he was born a native American by birthright.

Cruz's status will continue to be debated he was born with dual citizenship and later chose US citizenship.

Cruz-GoldmannSachs came off as nasty attacking
Mr. Trumps mother. And Cruz sounded evasive
about his being bought by Goldmann Sachs, just
like Ms. Cruz.

Actually, although I am a Conservative so naturally support the most Conservative (proven) candidate, I said I would vote for Trump if he got the nomination.

Now I will not. Partially because of the rudeness of Trump supporters here who used to claim to be Conservatives and now bash the Conservative candidate.

Also because of his lack of depth and knowledge on the issues.

I am sick of hearing the uninformed opinions of "Constitutional Experts" who have not actually studied the issue and who just shoot from the hip.

I and others HAVE studied this issue quite extensively, and what we have discovered is that people have been heavily misled on this issue since the later half of the 19th century.

The legal community is the absolute worst place to look for accurate answers because they are stuck on this concept of "Precedent uber alles" even when precedent is misapplied.
