Judge Orders New Jersey "Gay Conversion" Nonprofit To Close

NEWARK, N.J. -- A New Jersey nonprofit found to have violated consumer fraud laws for offering therapy it said would turn gays to heterosexuals must shut down, a judge ordered Friday.

The granting of a permanent injunction against Jews Offering New Alternatives for Healing, known as JONAH, was an outgrowth of a lawsuit filed against the group in 2012 by several men, and two of their mothers, claiming it engaged in fraud and made claims it couldn't back up.

The ruling signed Friday by state Superior Court Judge Peter Bariso ordered Jersey City-based JONAH to cease all operations within 30 days and barred it from "engaging, whether directly or through referrals, in any therapy, counseling, treatment or activity that has the goal of changing, affecting or influencing sexual orientation, 'same sex attraction' or 'gender wholeness.'"

Bariso's order also awarded attorneys' fees and expenses to the plaintiffs' lawyers.

David Dinielli, an attorney for the men, said the decision sends a message to providers of so-called gay conversion therapy that the practice is fraudulent.

"The practice of conversion therapy, at base, constitutes fraud," he said. "It is premised on the lie that homosexuality is a disease or disorder. This case proved it to be a lie."

What a joke.

No conversion therapies are 100%.

I guess all smoking cessation therapies should close because not everyone can. Same with all drug cessation therapies.

Further, all the stupid, stupid psychological therapiex to convert violent crimials and rapists and pedophiles, still can stay in business, even tjough most of them can’t change.

But I doubt that militant smokers would bother to sign up in order to “disprove” the efficacy of the therapy. While might doubt the sincerity of the plaintiffs in this case.

Would they have the you-know-whats to shut down any scientology centers for consumer fraud? They claim that all of our problems are caused by the souls of aliens that were sent here some 50 million years ago and are embedded in our souls and they can “clear” anyone, for a “small” fee, usually in the 100’s of thousands depending on how famous you are.

I’d agree if it was one person but this was quite a few people. There are other conversion therapy places in NJ that families can use that may offer better results. Just because they do good work doesn’t mean they should stay in business if they are not effective.

It is not up to the government to pick the winners in the market place. If their therapy doesn't work folks will stop going there, it is the free market. According to the Judges reasoning weight watchers ought to shut down also, it only temporarily works for most members, and Jenny Craig has some horrific results too. Jabba the Hut loses five pounds and then gains 20. I bet Gov. Christy wouldn't shut down the fat therapies.

This is an overreach for many reasons and it should be overturned.

The therapy is consensual between parties. The usual agreement in therapy sessions is that there are no guarantees so there can be no fraud or malpractice in a contract between the therapist and client.

Another view is that homosexuals are free to setup shop and act in the same capacity to convert heterosexuals to homosexuals based on consent and agreements that nothing is guaranteed.

Therefore, counseling in matters of sexual orientation is completely legal and should not be shut down by any court ruling because there is no law that would serve as a basis of any ruling to shut down such activities.

No it isn’t- at least not that I’m aware- it’s premised on the FACT that being gay is NOT a disease or disorder- it’s premised on the FACT that being gay is a sin, just like any other win, and people CAN overcome sin IF they work at it just as they can overcome any other type of sin if they work at it-

Someone correct me if I’m wrong- but most conversion therapy centers operate on the premise that being gay is NOT a disease or disorder

The lawyer for the defendant should have picked up on this

Exactly- and what was the ‘effectiveness rate’ anyways? Even if one person was helped, then it is effective- but as you say even if none were helped, the government does NOT have a right to step in and shut it down in a free market society

And therein lies the HYPOCRISY of the judge- ruling NOT on law, not on fact, but rather ruling based on personal bias

The lawyers for the defendant SHOULD appeal this ruling and make the case that the judge did NOT rule in an unbiased manner and prove this fact by showing that other businesses are able to remain open who are not very effective either-

Had this been cast as spiritual counseling, no complainant would have had a leg to stand on — it would come under free exercise of religion. “Healing” is probably the radioactive word here. “JONAR” wouldn’t have been as catchy, but to call it “Repentance” would have kept it out of the government bailiwick. Sometimes a little wisdom is called for.

Nothing is 100 percent effective. If you go to therapy of any kind and it doesn’t work, can you sue the therapist? Would you get a similar order?

This is a purely political ruling.
