Baltimore prosecutor Marilyn Mosby has withheld the autopsy report on Freddie Gray from defense counsel and the public for nearly two months. It is the report on which she relied to file murder and other charges against six police officers, even though the investigation into Mr. Grays death was not close to being complete. Now, just two days before Fridays court deadline for the state to disclose the report to the defense, it has been leaked to the Baltimore Sun. The Suns story makes it easier to understand why Ms. Mosby wanted the autopsy kept under wraps. It raises additional disturbing questions about her case a case in which she has already had to dismiss false-imprisonment charges, the untenable nature of which I explained when Mosby filed them. It turns out that Mr. Gray tested positive for opiates and cannabinoid. Moreover, he carried on wildly when initially placed in the police van. It had previously been widely reported that he was not belted into his seat, a violation of recently adopted Baltimore police policy that Mosby dubiously makes the plinth of her case. The Suns latest dispatch, however, indicates that Gray was making matters difficult for the police: yelling and banging, causing the van to rock, the autopsy noted. The van made several stops during its 45-minute ride. At the second one, six minutes after the arrest, Gray was reportedly still yelling and shaking the van. Police thus removed him and placed him in leg restraints ankle cuffs, to go along with the handcuffs that had already been applied. Once they sue and have the court removed from the Baltimore area and the entire case tried in western Maryland...the possibility of winning for the city is less than ten-percent in my humble opinion.
I am wondering how the six folks will sue the city for false charges later. Is there any history over this sort of stuff for cops with bad charges?

CAuse of death was trauma sustained while in the van. Seems to me that it was stupid to put him in restraints like this.
I told you Mosby was toast, and that they would try to save Rawlings-Blake...

Would love to see it but this is what would happen if they were found not guilty. A nano second later, in would charge Lynch and the O and they would file criminal charges for civil rights violations. This thing would last another 2-3 years and by then the defendants would be broke, if not before. Even if found not guilty a second time, they have no recourse unless they could prove prosecutorial misconduct which has a pretty high bar to beat. By then Mosby will be drinking champagne in some federal court house as a judge.
Hope the state dismisses the charges before trial which is unfortunately not probable.
I find it interesting that Mr. Roofs dream of sparking a race war is being fulfilled by the race baiters, politicians and media. (The last 2 are kind of redundant)

As an occasional viewer of COPS, I have seen this many times. A guy in the back of the police car starts banging his head against stuff...so they pull him out, add leg restraints, and lay him in the back seat unbelted.
Wise or not, its a common practice. The defense should call up the police chief, deputy chief, and down the line...and ask if they ever transported a prisoner unbelted.
If its a normal practice, its hard to call it 2nd degree murder.

After spending 25 years working with the police in what was commonly known as the most crime ridden area in the Northwest I can tell you from personal experience that trying to handle an individual like Freddie can be much more challenging and dangerous than most people can imagine. One time we went to a 100 pound girl described as normally a “church mouse” who someone at the Bingo Hall slipped some type of drug that caused her to have a psychotic episode. It took six LARGE cops and firefighters to restrain. And most of us managed to get scratched and bitten along with being spit on.
It sounds like they stopped several times, and at some point the guy stands up, and perhaps that’s when he was injured seriously.
I fail now to see how this is a homicide or reckless homicide or manslaughter or anything, and I bet that if they take the testimony of each individual cop, they will all tell the same story and not throw each other under the bus.
In other words, this was an unfortunate outcome, but it happens.
In looking at the arrest video, it looked to me like Freddie Gray didn't have use of his legs while being dragged to and into the van. Couldn't he have been injured during the actual arrest, which would exonerate at least the van driver (and possibly others)?
Plus... has anyone actually seen the full autopsy report, or are we still going on the Baltimore Sun's interpretation of their leaked copy of it?
