Even before it begins significant construction on the bullet train route, the California High-Speed Rail Authority has violated federal protections for the endangered San Joaquin kit fox in the Central Valley, federal regulators said in a letter last week.
The U.S. Fish and Wildlife Service said the authority had set up a nine-acre construction yard outside the approved footprint for the project, affecting habitat and resulting in the destruction of a kit fox den.
n a Jan. 26 letter, the service said the rail agency, along with the Federal Railroad Administration and its contractors, had failed to comply with the conditions of the bullet train's federal biological opinion on six distinct issues, including the failure to turn over biological survey reports that the wildlife agency had repeatedly requested in phone calls and emails.

Endangered species habitat and cultural resource surveys and determination of potential impacts and mitigation MUST be completed prior to a shovel hitting the ground.
This is done by preparing what is known as the APE or Area of Potential Effect which includes all gravel pits where materials will be mined, material stockpile sites, and contractor staging areas.
This is the most basic requirement of acceptance of federal funds. When I read about crap like this happening I get upset and confused especially since every project I’ve been involved with has under gone a federal audit and the hammer they wield over your head is the threat of having to pay the feds back all of the funds and potential criminal charges
Not to defend these idiots, but I have to point out that the San Joaquin Kit Fox may be listed as endangered, but trust me when I say it is extremely numerous.
You can’t develope or build anywhere here without the little bastards showing up to stop projects.
