Restaurant owner blasts city fines over single-gender ads

Bruno’s Italian eatery, Sistina, was slammed with its own $5,000 fine after a staffer placed an ad on Craigslist for a “hostess.”

In 2011, the Windsor, a Greenwich Village sports bar, was fined after a sting by the city Commission on Human Rights caught it trying to hire “waitresses” through Craigslist.

Gender-specific ads violate city civil-rights law.

Unlike the Windsor’s owners, Bruno says he’s going to fight what he describes as a “scam.”

“They want us to settle for $5,000,” Bruno told The Post on Thursday. “I’m not going to settle. I didn’t do anything wrong.”

Sistina, on Second Avenue at East 81st Street, employs a staff of 21 that includes three women.

One of them, Lara Kineavy, 24, said she posted the “hostess” ad on July 28 without giving a second thought to gender.

“I just wrote it as I would write any other ad,” she recalled.

“I just typed, ‘Hostess/coat check needed. Reliable, personable, organized.’ Really no gender specified.”

Kineavy, who doubles as a hostess and Bruno’s assistant, said Sistina’s e-mail account then received two résumés — one from a man and one from a woman. Both turned out to be “testers” from the commission.

Kineavy says Sistina did not respond to either e-mail. But in its complaint against the restaurant, the commission claimed only one e-mail — the one containing the woman’s résumé — was opened.

So the government put a tracking beacon in an email to monitor recipients actions! That is frightening and probably illegal. I hope he hangs them on that alone.

This sounds like it could be a freedom of speech issue. Is not anyone able to use the words “host” or “hostess?” And in our current pitiful culture, who is to say that either of those two words is gender-specific?

Either that, or they requested a read receipt, but those are inherently unreliable. The recipient's email client can be configured to ignore them or let the recipient choose whether to send the receipt or not when they open the message. The read receipt itself is sent as an email, and the protocol specifications for email say will tell you that it does not guarantee delivery.

Read/unread status indicators are a built in function of Outlook. They’re highly unreliable, as the recipient has to have Outlook for it to be honored correctly anything approaching 100% of the time.

“Read message receipt” can also simply be turned off in most programs that do honor it.

But it’s OK to use phrases like “hit MAN”, “mad MAN” and call it MAN-made global warming/climate change instead of something “gender neutral” as if we’re too stooopid an’ unsafistikaded to see the transparent attempt at subtle manipulation.

who is to say that either of those two words is gender-specific?

I remember back when "guys" was two or more men. My tip automatically goes down when our waitress addresses us as "you guys."

Well gosh!

In this enlightened city, can advertisers on such sites as Eros and Backpage not list whether the “escort” you arrange to meet is an anatomic or practicing male/female/whatever? Will they be required by law to have the proper “mix” available at such services and massage parlors.

Can such entrepreneurial enterprises be sued for showing (or not showing) photographs that at least hint at the sex/age/ethnicity/whatever of the person in question (assuming, perhaps naively, that we are talking just about “persons” . . . )

Can strip clubs there in this fine city discriminate by hiring only women dancers? Must the patrons be forced to endure the gyrations of any person of any of the plethora of “gender” configurations forced on us these days. Any age strippers? Any approximation of Ideal Body Weight? Any limitations on physical abilities?
