Nonpartisan organization confirms the GOP can defund Obama’s immigration order

Congressional Republicans agree that Barack Obama’s executive actions involving the extension of legal status to millions of illegal immigrants have to be fought. The GOP is, however, split on what methods would be the most effective in blunting or even reversing Obama’s actions.

Congress’s more conservative elements believe that a series of symbolic measures should be used in conjunction with more operationally focused tactics. Some, like Sen. Ted Cruz (R-TX), have suggested that Congress should not invite Obama to Congress for his annual State of the Union Address and that no presidential nominee should be confirmed until these orders are stricken.

Others believe that more practical measures should be taken, and those who support his approach have largely settled on a plan that would use a continuing budget resolution in combination with an omnibus spending bill to fund the government with the exception of Obama’s immigration enforcement measures. Allahpundit noted that the GOP is calling the plan “CROmnibus.”

Some like top House appropriator Rep. Hal Rogers (R-KY) have claimed that the GOP does not have the authority to de-fund the U.S. Citizenship and Immigration Services agency. “The agency has the ability to continue to collect and use fees to continue current operations, and to expand operations as under a new Executive Order, without needing legislative approval by the Appropriations Committee or the Congress, even under a continuing resolution or a government shutdown,” read a House Appropriations Committee statement.

On Wednesday, Sen. Jeff Sessions (R-AL) told Breitbart that a report via the nonpartisan Congressional Research Service contends that Rogers is incorrect. The CRS indicated that Congress can deny funds to the immigration enforcement agency despite the fact that it operates primarily on revenues collected through the imposition of fees.

A fee-funded agency or activity typically refers to one in which the amounts appropriated by Congress for that agency or activity are derived from fees collected from some external source. Importantly, amounts received as fees by federal agencies must still be appropriated by Congress to that agency in order to be available for obligation or expenditure by the agency. In some cases, this appropriation is provided through the annual appropriations process. In other instances, it is an appropriation that has been enacted independently of the annual appropriations process (such as a permanent appropriation in an authorizing act). In either case, the funds available to the agency through fee collections would be subject to the same potential restrictions imposed by Congress on the use of its appropriations as any other type of appropriated funds.

According to The Huffington Post’s Igor Bobic, this strategy would be the safest political course for the GOP. “Funding for that agency would then be contingent on the president’s willingness to rescind his executive action shielding millions of undocumented immigrants from deportation,” he wrote. “Under such a plan, Republicans would avoid a costly government shutdown fight and still offer eager conservatives a viable way to counter the president.”

They have the power and we voted for them to use their power. Use it or loose it republicans. Are you listening Mr. Boehner and McConnell? Meh, they want the power over us. They are not going to reduce the power that the demons grabbed but add to it.

We have to get tea party wild and vote for those who will do the will of the people.

In this case, only an initial appropriation, not annual appropriations, is required. Therefore, a statutory action is necessary to reverse the initial appropriation, which Obama can veto.

That is my understanding.

Does anyone have any G2 on Hal Rogers? From the look of him, he appears to be yet another POS RINO. If that’s true, KY is just as it’s name implies, something you put on to make things slippery. For a small state, they sure do give us crap for legislators.

Sessions and Rogers need to have a conversation where Sessions puts some southern educating into Rogers noggin.

There have been numerous statements out there saying, yes this would work. Now Huffington says yes.

Time for the GOPe to nut up and do it.

Most may have to go to the pickle jar where they have them stored to remember what they look like but it is time.

Constitution amendment needed? We need a Constitution amendment to stop presidents like Obama from abusing the power of executive action. Something like this:

"A simple majority vote of both the Senate and the House can overturn an executive order."

THE UNALTERABLE FACTS ARE THESE After his midterm trouncing, Obama was seething w/ hatred at being rejected. He desperately needed to assert himself. He needed an ISSUE.......any issue.

He was obsessed w/ hatred for Republican and the rest of us mental defectives taking up space in Progressive Utopia.

Seizing the opportunity, Boobamba vengefully threw a monkey-wrench into the new Republican majority then went on TV doing his "Compassionate Act.....blathering about those "in the shadows." Unfortunately, w/ that speech he stepped into a huge pile of steaming crap.

The "compassionate" Obama govt will record all their information including illegals' documents from their homelands: copies of their matricular cards, passports, names of family members, number of children, places of residence in the USA, as well as in their homelands, including full biometrics, fingerprints, DNA etc. etc. etc.....

Remember people, "THE PRESIDENT SAID" illegals should give federal operatives and agencies all their relevant info so that 5 million illegals "could come out of the shadows and stay." (sniffle)

Maybe I’m wrong, but it seems to me that Obama has it covered. If we cut funding, we are cutting funding to The Department of Homeland Security.

Including whether the action turns him into a “victim.”

I like Senator Cruz’s out of the box thinking.

While and POTUS must present congress with an annual SOTU, there is no requirement that it be given in person. Jimmy Carter was the last president to send a written SOTU, in 1981, so there is fairly recent precedent.

It would also deny Obama another chance to be an aggressive and offensive blowhard, like when he lashed out at the Supreme Court to their face, or his sneering at Republicans and conservatives. Or taking yet another opportunity to elevate Islam and deride Christianity.

Plus, the SOTU when given as an address, costs perhaps hundreds of millions of dollars and wastes weeks of government time, just to stoke the ego of the POTUS.

We keep voting for them ... "R's"... and get nothing. They laugh and say that they are fighting for freedom. We have two years to see if the Republicans will vote for our freedoms or the Obama agenda.
