Canadian court strikes down anti-prostitution laws

TORONTO (AP) — Canada's highest court struck down the country's anti-prostitution laws Friday, a victory for sex workers who had argued that a ban on brothels and other measures made their profession more dangerous. The ruling drew criticism from the conservative government and religious leaders.

The court, ruling in a case brought by three women in the sex trade, struck down all three of Canada's prostitution-related laws: bans on keeping a brothel, making a living from prostitution, and street soliciting. The ruling won't take effect immediately, however, because the court gave Parliament a year to respond with new legislation, and said the existing laws would remain in place until then.

Well it doesn't go into effect immediately, so no sex tours to the north, yet.

If it’s just an alternative life style, I will be legal here soon enough. After all, aren’t we discriminating against sex workers when we tell them they can’t ply their trade?

I personally support the ban on street soliciting, brothels, and minors being involved.

But if it's advertised in the back pages of some sleazy 'zine, who cares? You're not going to stop prostitution, unfortunately. But I don't have a problem with adults hooking up using classified ads and meeting somewhere. How is that different from going to the bar?

What is the point of electing legislatures when judges in Canada and USA just make up laws as they go along?

As far as legal prostitution goes, tobacco is legal too but is regulated and taxed so much its not worth it.

I wonder if this ruling will stand?

It will, but like with the abortion ruling they've punted it back to Parliament which is where such decisions should be made.

To all- please ping me to Canadian topics.

Canada Ping!

. . . legal here soon enough . . .

Not long til our own courts discover this new Basic Human Right. After all, as of today they've got 19 of the states roped into gay "marriage."

For all its 8 years of a red carpet rolled out to “gay marriage,” the entire country of Canada has fewer than 100 such “couples” to show for it.

What are they smoking? Prostitution is dangerous period. One is sleeping with a perfect stranger who could kill you.

In related news,

Oakland schools' mission to end child trafficking

SF Chronicle: "McClung knew that she and other school district officials couldn't fight the problem on the streets. But they could take it on in the classroom. Their goal, starting in the spring, is to give every seventh-grader in an Oakland public middle school an education on sexual exploitation and how to stop it."

They're calling it "child trafficking" instead of prostitution. There's no mention of penalties leveled at the johns who keep them in business.

Huh? 100 same sex marriages in Canada? Your source is off,
While the number of opposite-sex couples who took the leap into matrimony grew by only three per cent since the last census, the number of same-sex couples tying the knot  jumped by 181 per cent over the same period, from about 7,500 in 2006 to 21,000 in 2011.

After all, aren’t we discriminating against sex workers when we tell them they can’t ply their trade?

And what sex worker hasn't compared marriage, or even dating, to prostitution?

Usually their argument is that they are "honestly" selling, and delivering, sex in exchange for cash; wives and dates are selling sex, and not necessarily delivering, in return for food, shelter, and/or other "valuable considerations".

Another line of attack is that it is a violation of their right to freely associate (worked in striking down cohabitation laws) and to privately contract. That sex and "sexual favors" are not a regulated "commodity" in any other context; and that prenuptial contracts, which specify what types and how often sex acts are to be offered and performed, and which also specify financial arrangements and obligations, are legal....

It won't be long before the shoppers find an agreeable judge.

So far, the judge shopping is starting to work for polygamy.
