WA:Anti open carry page could land creator in legal trouble

A new attempt from a anti-gun advocate may just land the owner in hot water. Opened on August 23rd the page called 'Open Carry 911' with a mission to get citizens to call 911 if they saw someone open carrying a firearm, and tell the 911 call taker that they were being threatening. There is discussion of the page on the Wash. open carry forum.

Open Carry 911's mission statement reads

"I am starting a grass roots [sic] movement and encourage everyone to participate. If you see someone carrying a firearm call 911 and tell them the person is threatening others with a gun. Then sit back and watch them get spread eagle and patted down, questioned or even arrested. Americans should not have to wonder whether someone brandishing a gun is a "good guy" or a "bad guy". There is no way to know. Therefore, open carry laws are wrong and should not exist."

This misguided attempt to use the 911 system and law enforcement to further an agenda, and fear of firearms. What this page doesn't take into account is the potential liability that comes with calling 911 and making a false report. Indubitably if there is a call to 911 about there being someone threatening others with a firearm, law enforcement would respond with similar force. The subject of the call would no doubt be put at risk when a police officer held them at gunpoint.

Speaking to John, a open carry advocate he told examiner "Pointing a gun at anyone has a certain amount of risk to it and must not be taken lightly, so when an officer points a loaded weapon as someone, that persons life is at risk.

Calling 911 with a false report is more than "misguided". It is a crime.

I’m guessing a web page that directly tells people to violate the law probably is also against the law. Conspiracy to commit a crime, in all likelyhood.

In a country where we put a boy in jail for 5 months for a joke on a gamer board, seriously urging people to commit a felony should get this man in serious trouble.

I think that already happen in NV. A Walmart clerk reported a CCW as a man with a gun and acting threatening and erratic. It turned out to be a CCW shopping with his girl friend and family. At the entrance of the store the Las Vegas City police waited for him to arrive. All three officers pulled their gun out, but each yelled out a different set of instructions “freeze, hands up, and to the ground!”. When the CCW complied with one of the instructions from one officer, the other two fired because he did not follow their instructions. The entire episode was on store sec camera and tape, but the evidence later was lost when the family tried to sue. The family argued that the CCW was behaving normally in the store and did not act threatening or erratic. This whole incident started when the clerk called the police when she saw the pistol on the CCW owner as he leaned over to pick up a pack of bottled water and possibly embellished the report to get faster police response.

I agree . . . especially when the brandisher is a LEO. But who ya going to call?

Considering this is referencing something from the well-established semi-truthsite examinerdotcom, I am highly skeptical of the entirety of the claim.

In some places there is not a provision to charge it as a crime... Just making a report to 911 is viewed simply as a tip.

Not only should the jackass serve jail time for this, also needs to be sued for this, as should the hosting company.

The more the police are informed and experienced about open and concealed carry, the less vulnerable they are to being manipulated by such scoundrels.

One of the biggest things is when they see through the subjective, “There’s a person with a gun here and I feel threatened.”

Properly, the police dispatcher then asks them, “What is the person with the gun doing?”

“He’s sitting there drinking a coffee and reading a newspaper... In a *menacing* fashion! He has a gun!”

“By that description he is not doing anything unlawful. Please do not call the police emergency number except to report an actual emergency. Good-bye. (click)”

Or in a mental institution. Seriously. People who actually do stuff like that lack adult reasoning power, and may seem normal in the limited tasks they are assigned.
I worked with one guy during the early 2000s when George W. was president, and he ranted non-stop about how evil GWB was. Although I tried to avoid serious topics when chatting with him, the funniest event was when he announced that he was seriously thinking about running against Dubya in the next elections.

He was retired on medical disability (mental?) after a couple of years.
