CONTROVERSIAL CALIFORNIA BILL EXEMPTS PUBLIC SCHOOLS FROM SEX ABUSE LAWSUITS

California Senate Bill 131, which is ostensibly about protecting victims of child sex abuse, forces private schools to defend claims of sexual abuse as far back as 40 years ago, but exempts public schools from such claims. Because of the Democratic super-majorities in both houses of California, there is no way to stop the passage of the bill.

As Valerie Schmalz wrote in Catholic San Francisco:

The California state Senate narrowly approved a waiver of the statute of limitations for child sex abuse damage lawsuits – a bill that could have a devastating effect on nonprofits including Catholic Charities and Catholic schools while exempting public employers. The legislation, SB 131, would force private schools to defend claims that may be 40 years old but forbid victims from suing any public school for abuse that may have occurred before 2009, the California Council of Nonprofit Organizations said.

She quoted Ned Doleisi, executive director of the California Catholic Conference, adding, "To add insult to injury, SB 131 even protects the actual abuser from being sued – the only claims that are revived are against private employers and nonprofit organizations.”

If this passes, private schools should file a 14th amendment claim in federal court for both due process and equal protection clause violations.

It is a direct gift to unions, but did they purposely exempt non-public schools just because they can?
Does this mean that if a boy claims he is really a girl to be able to get into the girls bathroom (new transgender law) and molests a girl, no one is at fault?

Unfortunately this bill is less about protecting children then it is about trying to destroy alternatives to government schooling....

This is a “get even with the Catholic Church” law pushed by the gay lobby. Plain and simple.

Catholic school have been a thorn in the side of the public school system for many years. This is a chance to rid themselves of the Catholic school system for good.

Is there really anyone left who was molested forty years ago who has not come forward? It’s nice to be able to blame someone who’s dead and cannot defend themselves. My heart absolutely goes out to those legitimately victimized. But there are also those who weren’t abused who jumped on the bandwagon and said “me too!” just for the cash. It’s amazing, you can’t or don’t usually sue if you’re molested by a relative. Now by a public school employee either.

Really, the only solution I can see is what the Egyptians are doing. (And in Turkey, Bulgaria and Brazil; I think a few more are percolating.) When layers of government are being run by utterly corrupt immoral power mad psychopaths, elections are rife with criminal fraud, and millions of gov employees who although powerful are not even elected so there is not even the pretense of trying to get rid of them, what other choices do we have to turn this around? Let me know if anyone has any ideas! I've run out of ideas and other than mass street protests, civil disobedience and national strikes, I can't think of anyhting!

also there is a devastating suit in LA because a hunch of kids at one school were fed sperm cookies by a teacher and I think a bunch of other things.

This will come in over 100 million.

If the LSA school district was a private business it would have folded up years ago.

The pols want to make the school districts exempt so that they keep bennies going to the teachers and keep schools opened which should be closed and merged.
