Did New York State Just Accidentally Outlaw ALL Firearms?

Did the New York state legislature just accidentally make it a crime to merely OWN a firearm?

See page 22 of the posted bill, s2230:

§ 41-a. The penal law is amended by adding a new section 265.01-b to 5 read as follows:
6 § 265.01-b Criminal possession of a firearm.
7 A person is guilty of criminal possession of a firearm when he or she:
8 (1) possesses any firearm or;
(2) lawfully possesses a firearm prior to
9 the effective date of the chapter of the laws of two thousand thirteen
10 which added this section subject to the registration requirements of
11 subdivision sixteen-a of section 400.00 of this chapter and knowingly
12 fails to register such firearm pursuant to such subdivision.
13 Criminal possession of a firearm is a class E felony.

If you’re caught with an unregistered gun.

Criminals don’t care and folks at home don’t care either. If they’re arrested - a felony charge is the price to be paid for self-protection.

People won’t stop doing that no matter how severe the threat of punishment leveled against them might be.

That would be 2/3 of both houses of Congress and 3/4 of the states (unless I missed Constitutional Convention).

Does line 2 say that you are guilty of criminal possession of a firearm if you legally possess a firearm before the effective date of the law?

Sounds like a retroactive criminalization of gun ownership.

In computing languages AND binds tighter than OR, so A OR B AND C means A OR ( B AND C ). Perhaps in legalese AND and OR have equal precedence and are left associative. Hard to imagine, but I could see it.

i believe you are correct, the and only applies in 2), not 1). it’s either condition 1) OR condition 2).

they just banned all firearms. i hope the revolt removes cuomo from office.

Au contraire. Parens indeed do affect the way it’s parsed. It’s only syntactic sugar when the parens aren’t really needed and operator precedence and order of evaluation just so happen to coincide with what the programmer “meant”. And in the latter case you just got lucky, sloppy, but lucky. Many a bug has been attributed to it.

YOU ARE CORRECT! Research how gun registration, etc. worked in Canada. It DID NOT WORK because people refused to comply. I saw a post form a Canadian who explained it in detail, but goldstategop, you are correct.

It is against the law in the city of Chicago to carry a gun, and yet, they have the highest crime rate. Are you hearin’ me? We must resist, refuse, delay, obstruct, sabotage this ahole in OUR White House in any way we can. Go underground, do what you have to do to get what you need.

Looks to me like you're guilty if you lawfully owned a firearm before this law went into effect. Whether you still have it or not even.

Looks like the ol' calculated "blunder," a law meant to be struck down.

It'll be tossed fast enough that they don't have to risk the enforcers' necks.

Yes, it does. It doesn't give any limit to how long before the law went into effect either nor does it say you have to still be in possession of it. IOWs if you ever lawfully owned a gun before this law, whether you still have it or not, you are now guilty of criminal possession of a firearm.

0bamugabe is using children as props and Cuomo is using them to write laws apparently.

Yup- many on the right- pundits that is, are already pushing him to run- I swear that the left has somehow infiltrated the right and is destroying the party altogether- just as the leftie pinko John Roberts of supreme court betrayed the American peopel and his party- He delivered what WILL amount to a death blow to this country by his refusal to uphold the constitution of the United States- and by givign the left free unimpeeded reign- He let the left know that the supreme court will NIOT stand in his way no matter how many consitutional violations he commits-

This country is in a bad bad place- and the spineless GOP have pushed us into htis no win situation by their refusal to serve their constituents and by cavign in to the left over and over and over again

Yes, that’s correct because the penal code 265.01 has been amended with 265.01-a. Possession is now a crime in NY.
