Prop. 8 Judge: 'What Judges Do and Must Do Is ... Move the Strike Zone'

Judge Vaughn Walker, the now-retired federal judge in San Francisco who nullified California’s Proposition 8 in 2010, said if judges really are umpires, they must sometimes “move the strike zone” in order to champion social issues like same-sex marriage.

“Case by case, what judges do and must do is take account of the pitcher and the batter in the legal arena, watch the windup, the throw, the curve, and the delivery and then, where they believe appropriate, move the strike zone,” Walker wrote on Aug. 28 in the University of Illinois Law Review.

But Walker, flouting Justice Antonin Scalia and other strict constructionists, said that “judges not only make law, but cannot avoid doing so.” …

Congratulations to Ted Olsen, former conservative, for somehow getting (and keeping!) a faggot judge to hear his case for overturning the overwhelming will of the people. Nice win, Ted. You sick scumbag.

The fact that Mittens’ VP Ryan tapped that scumbag Olsen for help in his debate prep gives me great pause. Olsen is the kind of scum he should avoid like the plague.

Like others, I'm of the opinion that this man was never qualified to be a judge in the first place.

He thinks a judge is a king with a lifetime appointment.

Just imagine how much damage he must have done in his career.

No, you don’t “move the strike zone,” you uphold the LAW as written.

Any judge who violates that simple rule should be immediately removed off the bench.

This is outright admission that he violated his oath of office as a Justice. His cases should all be reviewed formthismillegal bias and retried.

Further, he should end the rest of his natural life in jail.

Too bad it’s too late to impeach him; but how about suing him for malfeasance, with forfeiture of pay & benefits; and reimbursement of all pay & benefit costs for the time spent on cases in which he gave suspect rulings?

Or maybe just tar & feather him, before hanging him from the nearest lamp post, to cut our losses.
