Ex-Marine to sue over detention for Facebook posts

The former Marine who was forcibly placed in a psychiatric ward by government officials who didn’t like his Facebook postings will sue for unlawful arrest, according to his attorneys.

“We are definitely going to move forward with a lawsuit,” said Nisha Whitehead, assistant to the president at the Rutherford Institute, the nonprofit civil rights firm defending Brandon Raub.

I totally agree, the people responsible should be prosecuted for everything possible. The abuse of power should be harshly punished.

Over the last few decades, I think I’ve convinced myself that we are going about protecting our rights from government intrusion and oppression all wrong.

I believe, that instead of contributing to a GOP or other conservative party, we should instead encourage the formation of a liberty defense corps comprised of CONSERVATIVE legal talent focused solely on tying this government up to its neck in neverending lawsuits for breach of liberty. Inundate them with lawsuits like they’ve been doing for decades. Fund it, DO it, support it and use it.

Amen. Deprivation of civil rights under color of law is a Federal felony. The civil suit should be settled out of the responsible LEO’s retirement accounts.

I take this guy with a huge grain of salt (support of Alex Jones type conspiracy theories; look it up) but if his detention was unlawful, sue hard.

Was this guys detention any different or worse than Hal Turner of NJ ?

They both voiced perceived threats and yet Hal Turner is still in jail.

That’s the problem. Unless Rutherford can figure out a way to sue the individuals who acted ‘under color and authority’ of the govt ... it’s the govt, i.e., taxpayers, who will pay for these rogue fed employees. I sure hope Raub collects big time.

agreed and a law group should be looking at the first amendment especially as that is really under threat.
Freedom of religion, to some judges and lawmakers they think it means no religion
Freedom of speech but to some judges etc they think its only applies to the left.

Now Ann Romney has got death threats and will this racist DOJ and Holder doing anything?
Will they hell.

Why is Holder still there anyway, ? He should have been forced out and the DJ overhauled right after they dropped charges against the racist black panthers

Good point. There are a number of conservative funds out there but they don’t enjoy the funding support that the ACLU et al. enjoy

Sue? Heck Yes! Because once he’s won a Civil Suit, where the burden of proof is Lower than in a Criminal Prosecution, he will then Have the Civil victory in his favor to go for the Criminal Prosecution.

He may have a tough road to hoe on this one. This wasn’t the local podunk that went after him, it was the FBI and SS, and they would have almost certainly gotten AUSA concurrence on this prior to snatching him up.
All the AUSAs that I worked with were very demanding, rightfully so, and were not prone to whims and emotional breaks. They can afford to be choosy and skeptical.

Some tall folks thought there was probable cause to detain him for evaluation and it was done. I got the sneaky feeling that Mr. Raub may have put some really attention grabbing remarks on his facebook account that drew their attention. Remarks that have yet to be revealed publicly for some reason.

Not that the government does not err, I would just like to think that these agencies, which are supposed to be cream of the crop, (and having worked daily with them, I find this to be true in many respects) and that they would not make a rush to judgement.

Time will tell.

Another explanation could be a urgent directive to start paying much more attention to supposed “anti-government” types, real or perceived, in advance of the coming elections. Case in point, were the recent Army troops that were rounded up.

We all must recognize, right or wrong, that the government, in efforts of self preservation, will spend more time watching those in society who are potentially the most dangerous to them. Brandon is a former active duty Marine, with all the things that go with being a Marine, such as training, discipline, and leadership. Great life skills to have and for employers to have, bad for governments who are divergent.

Go read the interview of Raub by the attorney, he is only 1 of 30 taken from his VA county over the last month. They estimate the roundup of ex-military in the US to be @ 200k...
