70% of Arizona Voters Favor New State Measure Cracking Down On Illegal Immigration

The Arizona legislature has now passed the toughest measure against illegal immigration in the country, authorizing local police to stop and check the immigration status of anyone they suspect of being in the country illegally.

A new Rasmussen Reports telephone survey finds that 70% of likely voters in Arizona approve of the legislation, while just 23% oppose it.

I’m curious. I’ve seen a number of even (so-called) conservative commentators say that states don’t have the right to make a law like this one. Can that be true? I confess, I’m not a lawyer, but wouldn’t this fall under the 10th Amendment?

Interesting that the opposition is focused entirely on brown skinned people, yet the law speaks to ALL undocumented individuals. Based on my experience with cab drivers [from Russia, Pakistan, Yemen, etc.] in major cities, there are more than brown skinned people that will be compelled to show either visas or proof of citizenship. That is a good thing.

California Proposition 187 (also known as the Save Our State initiative) was a 1994 ballot initiative designed to prohibit illegal immigrants from using social services, health care, and public education in the U.S. State of California. It was initially passed by the voters but later found unconstitutional by a federal court, with appeals against the judgement being halted by Governor Gray Davis in 1999.

I believe protecting our borders is an oath of office the president takes...as well as all elected officials, in the oaths of office they are charged to protect and defend our nation.

Federal Immigration and Nationality Act
Section 8 USC 1324(a)(1)(A)(iv)(b)(iii)

State and local law enforcement officials have the general power to investigate and arrest violators of federal immigration statutes without prior INS knowledge or approval, as long as they are authorized to do so by state law. There is no extant federal limitation on this authority. The 1996 immigration control legislation passed by Congress was intended to encourage states and local agencies to participate in the process of enforcing federal immigration laws. Immigration officers and local law enforcement officers may detain an individual for a brief warrantless interrogation where circumstances create a reasonable suspicion that the individual is illegally present in the U.S. Specific facts constituting a reasonable suspicion include evasive, nervous, or erratic behavior; dress or speech indicating foreign citizenship; and presence in an area known to contain a concentration of illegal aliens.

The Arizona law is actually enforcing the laws of the United States that the Obama won’t enforce.
