What Is Fundamentally Wrong With The So-called Healthcare Legislation?

1. It destroys the balance of power between the three branches of government. The real issue here is not about improving quality and lowering the cost of healthcare, it is about the Executive branch of government seizing unchecked power and limiting the right of self-determination specifically reserved by states and the people in the 10th Amendment.

2. It is unconstitutional. Nowhere in the US Constitution or the 27 Amendments has the Federal government been authorized to mandate or even regulate healthcare. To do so usurps power and violates well-established states rights that existed before the Federal government was formed.

3. It is oppressive and just plain wrong. It is a really bad idea to force people to purchase government-sponsored health insurance against their will under threat of retribution in the form of a tax (penalty) or even imprisonment for failure or refusal to do so. To add insult to injury, this legislation purports to be absolute. It does not afford citizens the right of redress if prosecuted.

4. It claims to be universal but does not treat all citizens the same. Arbitrary exemptions allow certain groups such as members of Congress, government employees, Trade Unions and at least one state to opt out or participate in enhanced programs not available to the rest of us ordinary folk.

5. It is dishonest at its core. The projected costs and deficit numbers are contrived, based on unreasonable assumptions and wild predictions that cannot be proven or supported unconditionally by the CBO. Citizens know it and those who voted for the legislation should have known. It appears that votes were bought and traded with impunity that disgraces the once-sacred oath of office. Plus, the manner in which the legislation was enacted circumvented usual procedural rules, due process and ignored the will of the people.

Respectfully, I must ask: how can citizens respect a government that ignores the balance of power required by a democratic Republic and violates the US constitution; practices enforcement of laws that threaten retribution without redress; fails to afford equal treatment or protection under the law; and ignores basic standards of honesty? I have no doubt that you value freedom of speech and thought - as do I. Our freedoms include the right and perhaps the obligation to criticize government and our elected leaders, especially when they have really bad ideas or seek to usurp power. When government oppresses the people with such legislation, I believe citizens have a duty to speak up and take appropriate action.

Any one of these five compelling arguments should be sufficient to repeal the worst piece of legislation to be foisted on the American people since Prohibition. I understand your political affiliation and party loyalty dictates that you disagree with my opinion publicly, but in the name of good common sense, how can you personally dispute a citizen’s analysis as stated above? I trust you will eventually come to your senses and considering repealing this plague being visited upon the nation formerly known as ‘the land of free and home of the brave’

1. Nothing in the Constitution that Authorizes it.

Bukkaki O'Bunga is going to destroy this country, and he's well on the way to doing it. The partisan years of Clinton's and Bush's presidencies were child's play compared to the deep rift of ideological division created intentionally by this Communist ass-monkey.

He should be dragged out of the White House and put on a boat back to Kenya, where he and his cousin Raila Odinga can have fun destroying that putrid sh*thole.

He's an enemy of, and a clear and present danger to, both The Constitution and The Republic. A sociopathic public menace who must be addressed as such.

The “efficiency” argument is specious. When coupled with the ever-elastic, un-enumerated Commerce Clause, the next area of federal takeover could be food. We could save so much money if every neighborhood had its own government kitchen and eating hall. We could purchase food in bulk and we could cut back on food stamps. It is just unfair that some people had ‘Cadillac’ eating while others are left to pick from garbage cans.

After we use the Commerce Clause to impose that, we’ll move to saving money by forcing everyone into highrise efficiency government housing. After all, everyone needs a place to sleep. The dormitories are so much more energy efficient than single-family dwellings. And is so unfair that some people get to enjoy ‘Cadillac’ housing while others are left to sleep in government-funded homeless shelters.

We we all need clothing. Do we really need all this variety? I don’t think so! We could save so much money if government experts would design just 5 differnent types of clothing: manual worker uniform, health care worker uniform, office worker uniform, enforcement worker uniform. We only need the leisure time outfit in two sizes with elastic stretch pants in two exciting colors. We could save more by just using modified military clothing.

Doesn’t the left have a wonderful Utopia in store for us?
So energy efficient?

BTW, didn’t that article on thorium reactors say we had enough thorium to last us at present levels for 1000 years or so? And we are worried about running out of energy? What kind of morons do we have making policy now? Gaia worshipers?

Judge Kithil of Marble Falls, TX - HB3200 highlighted pages most egregious.

Please read this .. especially the reference to pages 58 & 59

JUDGE KITHIL wrote:

To start with, it is estimated that a federal bureaucracy of more than 150,000 new employees will be required to administer HB3200. If we are going to hire 150,000 new employees, let’s put them to work protecting our borders, fighting the massive drug problem and putting more law enforcement/firefighters out there.”

JUDGE KITHIL continued: “Other problems I have with this bill include:

** Page 50/section 152: The bill will provide insurance to all non-U.S. residents, even if they are here illegally.

** Page 58 and 59: The government will have real-time access to an individual’s bank account and will have the authority to make electronic fund transfers from those accounts.

** Page 65/section 164: The plan will be subsidized (by
the government) for all union members, union retirees and for community organizations (such as the Association of Community Organizations for Reform Now - ACORN).

** Page 203/line 14-15: The tax imposed under this
section will not be treated as a tax. (How could anybody in their right mind come up with that?)

** Page 241 and 253: Doctors will all be paid the same
regardless of specialty, and the government will set all doctors’ fees.

** Page 272. section 1145: Cancer hospital will ration
care according to the patient’s age.

** Page 317 and 321: The government will impose a
prohibition on hospital expansion; however, communities may petition for an exception.

** Page 425, line 4-12: The government mandates advance-care planning consultations. Those on Social Security will be required to attend an “end-of-life planning” seminar every five years. (Death counseling.)

SO PALIN WAS RIGHT - THERE ARE DEATH PANELS!!!

** Page 429, line 13-25: The government will specify
which doctors can write an end-of-life order.

HAD ENOUGH???? Judge Kithil then goes on:

“Finally, it is specifically stated that this bill will not
apply to members of Congress. Members of Congress are already exempt from the Social Security system, and have a well-funded private plan that covers their retirement needs. If they were on our Social Security plan, I believe they would find a very quick ‘fix’ to make the plan financially sound for their future.”

The bill should be called, "The bloodless coup of 2010".

This is a Trojan Horse bill, with little or nothing to do with healthcare. In fact, I believe that in 2014 this will be thrown back out to the insurance companies in a complete mess for them to figure out, and the feds will keep the "control" parts to keep us all in check.

That is, providing it doesn't get repealed, defunded, or declared unconstitutional.

Considering the hooks and crooks and fevered pitch at which this was rammed through, there is no way it can be anything else except the great coup of 2010.

We have been skunked by a shiftless little punk from kenya...we should be ashamed. His was a "manufactured" presidency, planned and implemented during all of the "hate George Bush" distraction of the past 8 years. Everything was set - obama was hand-picked and given the fast track through Harvard and the senate to arrive just in time for the election.

All he had to get was a few crossover votes and some liberal white votes (which is why a half-white was picked), add a white VP (albeit dumb as a bar of soap) and he was in.

Whomever is pulling his strings is really a smart person, everything was pulled off like clockwork...but there was one, fatal mistake.

They pushed too hard, and too fast, and woke up the sleeping giant...the American people. They are hapless thieves who broke the window instead of opening it quietly, and it woke us all wide awake.

I'm still not sure if those inside the beltway woke up yet, but I'm sure some of them did. Others are just helping him kill the golden goose.

We're now down to the "what if's"...what if it doesn't get repealed? What if we can't defund it? What if the Supremes let it stand? What then?

It's time we did some planning of our own and figured out the next step(s).

Fool us once, shame on obama...fool us twice, shame on us.

It was never design nor intended to “fix” anything!

The objective was ALWAYS to maximize control over the electorate, by reducing their Constitutional freedoms, increasing their taxes, ruining free markets, American business, and industry.

Obama HATES America and what it stands for!
His ONLY objective is to reduce it to a second rate, socialist nation, under the permanent control of socialists.

Actually, that is not Rove’s job .. it’s actually the job of the RNC .. but they don’t seem to be that engaged in this process at all. I can tell you if the RNC would make a few commercials with these parts of the bill in big letters, the donations would be pouring in.

I don’t have a clue why nobody is paying attention!

IMHO is a bunch of horse hockey.

Go read the pages for yourself and find the specific instance where the gov will have access to your bank account.

I am not sure if these references are correct. The author does not inspire confidence by false claims that members of Congress do not participate in Social Security.

These refers to 3200 which is not the final bill, 3590 is. Some of this is ambiguous in 3200 as I read it, but it some instances it looked plausible and true to meaning. The legal language is written in dense code (which is Obama’s MO) and the Judge’s interpretations may actually be correct - wait for more input.
