Prosecutors deciding whether to charge the woman who falsely reported that she was gang-raped in a Hofstra men's room last week will have serious issues to weigh, experts said Monday.
On the one hand, they will want to discourage people from lying to law enforcement, and show that there will be consequences for doing so, experts said. On the other, they don't want to discourage legitimate rape victims from coming forward, or discourage people who lied at first from telling the truth later on, experts said.
"That's the tension right now in the D.A.'s office," said Jim Cohen, a criminal law professor at Fordham University. "There should be some sanction for the consequences she caused," he said. "On the other hand, if they charge this woman, then someone similarly situated in the future might decide to stick with her story rather than coming clean."

She should serve as many years in jail as the ones she falsely accused were at risk for.

If you charge this woman, then perhaps these type women won’t make these false charges to begin with when they consider they might just go to prison over it!
You don’t get a free pass to scream rape because it is convenient to your situation. Real people have real harm done to them that may never go away. Someone who willfully falsely charges someone with rape should do significant prison time.

Absolute bullshit - don’t worry about future possible maybe...blah blah - charge this woman with lying to officers - make an example out of her and maybe others will get the message. And I hope the boys sue her butt....
Charge her and find her guilty as a deterrent of other low lifes thinking about trying the same thing.
At the very least she should sit in jail for the same amount of time that each of her victims did.

Scenario 1
a) make up a rape charge
b) evidence doesn't support rape charge
c) recant the rape charge, it was all OK, nothing to see here
d) don't get in any trouble.
-OR-
Scenario 2
a) make up a rape charge
b) evidence doesn't support rape charge
c) go to the mat with a zealous politically minded prosecutor
d) lose your case
e) STILL claim that it happened even though all evidence points to you being a liar
f) STILL don't get into any trouble.
Something needs to be done about discouraging (a), the invention of said charges, a LOT more than any potential disincentive for Scenario 1 (c) the recantation of said charges.
But that is just my opinion.
I think this stinks. The only news stories I see simply say that she admitted the sex was consensual. Then the headlines say whe “made the whole thing up”. Whoa! What did she make up? Did she have sex with all 5 men ... in the men’s room? But now that she thinks about it, she was loving it? The men are not saying what happened. This is in no way equivalent to the Duke case, where the accused steadfastly denied that any sex took place between the accuser and any of them.
Recall in the 80’s they used to have women’s meetings where they told them, “Remember all those times you had sex? Did you really want to do it?” ... “Gee, well no, I guess.” ... “You were raped!” ... “Yeah, I was raped!”
Now, it’s different.
Female DA in that county.
This isn’t like she was confused about what happened.
Fry her.
Throw this skanky whore into jail. The law is the law. Period.
