John Hinderaker over at Powerline has copies of a letter to Ronnie Earle, and one of two motions to quash the two new indictments of Tom Delay.

"Earlier today, Tom DeLay's lawyer, Dick DeGuerin, moved for dismissal of the second indictment which was procured by prosecutor Ronnie Earle. Here is DeGuerin's letter to Earle that accompanied the motion:
"The judge who will hear DeLay's motions is a MoveOn.org supporter. But Ronnie Earle will have to come up with some answers if he wants to keep his prosecution of Tom DeLay alive."

Aren't the people who run Powerline lawyers? Would they post information about this rumored motion if it didn't have a good chance of succeeding?
The motion exists. They post it just as reference material. They also poseted the letter that accompanied a subpoena to Earle, to compel him to appear, since the motion for dismissal rings of prosecutorial misconduct.
I looked at the case on the merits, and Ronnie Earle seems to be blowing smoke. I have no idea if the prosecutorial misconduct charge has anything going for it, haven't reviewed it.

A moveon.org member is, by nature, illogical and, as George Washington identified in his Farewell Address, consumed by party spirit. Expect them to embrace all mischevious deeds while claiming innocence.
