Backing Limbaugh, ACLU goes to court

WEST PALM BEACH, Fla. -- Rush Limbaugh and the American Civil Liberties Union do not agree about much, but they are in accord that the conservative radio commentator's medical records should be off-limits to prosecutors.

The Florida ACLU filed court papers yesterday supporting Limbaugh's argument that investigators violated his constitutional right to privacy when they seized his medical records in November to investigate whether he violated drug laws when he purchased prescription painkillers.

"It may seem odd that the ACLU has come to the defense of Rush Limbaugh," the state chapter's executive director, Howard Simon, said in a statement. "But we have always said that the ACLU's real client is the Bill of Rights, and we will continue to safeguard the values of equality, fairness, and privacy for everyone, regardless of race, economic status, or political point of view."

The ACLU is trying to jockey for conservative dollars.

Howard Simon, said in a statement. "But we have always said that the ACLU's real client is the Bill of Rights

Except the second amendment in the Bill of Rights, which the ACLU claims enumerates a right of the government, not the people.

Everyone should open-mindedly study the ACLU, their history and their obvious hypocrisy.

The ACLU is the most hypocritical group of anti-Christian bigots that ever gained a foothold in this country.

They have lied about their true intentions from the beginning, a fact which any honest person can easily recognize. Their true goal, their frenzied purpose for existance is to destroy the influence of the Christian world-view which was always the basis for our law and or culture. They could not overcome the American voters or the U.S. Constitution so they used deceitful, elitist lawyers and judges to illegally rewrite the meanings. They then used the willing law schools and the media to drumbeat their lies and ridicule any truthful person who opposed their continuing lies.

The ACLU now has a large group of brainwashed lemmings who believe in the same 'fundamentalist humanist' basis for historical American law. It is a lie and it is too bad even some on FR have bought the lie just like Chuck Schumer and the democrat party leaders.

This sentence kinda contradicts itself.

Post 19: Why would Rush need help from the ACLU?

You're right, Rush doesn't need any help.  What I like (for me) is seeing an emerging sense of revulsion in the greater community over what's been going on.   It's good to see it in the ACLU as well as other places.

Nothing good can come by way of the ACLU, IMHO.

I will clarify.

Some who believe the ACLU line are close-minded to the ACLU's obvious hyposcrisy and need to open their minds to the truth about the ACLU.

Better?

So now Rush is citing Right to Privacy as outlined in the 14th to prevent the police from obtaining his medical records.

Rush is fighting in state courts. The right to privacy is a explicit right in the Constitution of the State of Florida:

SECTION 23. Right of privacy. Every natural person has the right to be let alone and free from governmental intrusion into the person's private life except as otherwise provided herein. This section shall not be construed to limit the public's right of access to public records and meetings as provided by law.

This is not just a ruling for Rush...this decision is going to affect us all in the long run. How can they try to convict you on 'possible evidence that they may find' through your personal medical records? As Rush has said...this is just a fishing expedition.

Okay thanks, but when Roe is overturned it looks like abortion will remain legal in Florida.

I was not addressing the validity of this case, I was just correcting the poster who thought that Rush was fighting in federal court using the US Constitution.

I suspect that Rush will lose his appeal to the Florida Supreme Court, but I did not address this outcome in my post.

I cannot believe that the ACLU would do anything to "help" Rush...they are doing this for their own agenda driven reasons and for that alone, if they can "piggyback" on Rush's case it gives them some free publicity.
