Backing Limbaugh, ACLU goes to court

WEST PALM BEACH, Fla. -- Rush Limbaugh and the American Civil Liberties Union do not agree about much, but they are in accord that the conservative radio commentator's medical records should be off-limits to prosecutors.

The Florida ACLU filed court papers yesterday supporting Limbaugh's argument that investigators violated his constitutional right to privacy when they seized his medical records in November to investigate whether he violated drug laws when he purchased prescription painkillers.

"It may seem odd that the ACLU has come to the defense of Rush Limbaugh," the state chapter's executive director, Howard Simon, said in a statement. "But we have always said that the ACLU's real client is the Bill of Rights, and we will continue to safeguard the values of equality, fairness, and privacy for everyone, regardless of race, economic status, or political point of view."

Rush is for abortion rights? or do you mean that this means he's for abortion rights only by association?

>>But we have always said that the ACLU's real client is the Bill of Rights

That is pure Barbra Streisand (BS). The ACLU's real agenda, from the beginning, is Marxism. If you want confirmation, research how many times the ACLU represented "The Right of the People to Keep and Bear Arms", or "Free Exercise of Religion". They are left-wing, Marxist liars (of course, left-wing, Marxist, and liar are redundant).

Roe v. Wade is based on the 14th Amendment and the 'right to privacy' as seen by the Justices when the decision was made.

Rush is agreeing that the 14th Grants a Right to Privacy and is basing his defense on that theory.

Go read the 14th and see if you see anything that may even imply a 'right to privacy.' I do no see it and therefore believe Roe v. Wade was a flawed decision.

However, from the looks of his Defense it would appear that Rush believes the 14th grants a Right to Privacy and therefore believes woman have a right to privacy when it comes to visiting an abortion doctor.

Why couldn't Rush choose one of these organizations?

I don't think Limbaugh himself had anything to do with the ACLU getting involved. He didn't ask them to, and he's mentioned their involvement only in passing when commenting on his case. He sure isn't plugging the ACLU.

Having said that, however, I wish he would have gone on the air early on and publicly told them "Thanks but no thanks." Maybe he felt at the time that he needed all the friends he could get.

Hey Jay, Rush has been using the Landmark Legal Foundation. He and Mark Levin are real close.

Rush is basing his case on a Florida law which says medical records are to be obtained by subpoena and prior notice.

I don't believe the US Constitution has been used by his defense attorney.

Rush may not have invited the ACLU on board but Rush is maintaining that he has a RIGHT TO PRIVACY the very same Argument made by Roe in Roe vs. Wade.

Now does Rush only support HIS Right to Privacy or does he also support a woman's Right to Privacy when visiting her doctor?

The posted article states:

Looks to me that he is citing his right to privacy.

AFAIK, the only contention by Roy Black is the violation of the Florida statute governing medical record privacy. Now, perhaps the ACLU raised the issue in their filing, but I don't think the Rush team has.

The Florida Constitution does have a specific clause guaranteeing a right to privacy. I'm not a legal expert and cannot cite the article or section, but I know that it does exist. The article is unclear (typical for the agenda-driven rubbish that passes for "journalism" these days; never let facts get in the way of spin) about whether this action is in state or federal court, but I'm pretty sure it's state.

I hope you are right but there seems to be a clear linkage between what Rush does with his doctor(s) and what a pregnant woman does with hers.

It would seem to me that Rush would have the easiest path by citing the 14th but that would place him in a compromising position on the abortion issue.

I would hope Rush would do the time as opposed to supporting abortion.

The killing of millions of babies is much larger than Rush.

I agree; it certainly hasn't stopped him yet (from verbally attacking the ACLU).

Rush did not "choose" the ACLU.

They are not representing him.

The ACLU has filed a "friend of the court" brief explaining their position on medical privacy to the judge and how it applies to Rush's case.

Rush had absolutely nothing to do with it.

WITH a legit WR, McNabb's stats are pretty nice this year -
300 completions out of 469 attempts for 64.0% completion, 31TDs and 8INTs

Rush may know politics(and I'm not convinced about that), but he knows dick about football =)

Even a stopped clock is right twice a day. The ACLU is not a friend of conservatism, patriotism, or America.

Reminds me of an Onion headline from a few years ago: "ACLU Defends Man's Right to Firebomb ACLU Offices"

LOL!

Yes it does, and a specific statute governing medical privacy.

States can grant citizens rights in addition to federal rights.
